Witham Memorial Hospital Patient Portal Privacy Settlement

Patients of Witham Memorial Hospital who logged into their patient portal account at any time between Jan. 1, 2020, and Dec. 31, 2023, may be eligible to claim $25 from a class action settlement.

The Board of Trustees of the Flavius J. Witham Memorial Hospital agreed to settle a class action lawsuit alleging it disclosed confidential personally identifiable information and/or protected health information to third parties without patient consent.

Who can file a claim?

Class members must meet all of the following criteria:

• They are or were a patient of Witham Memorial Hospital.
• They resided in the United States.
• They had a patient portal account with Witham.
• They logged into their patient portal account at any time between Jan. 1, 2020, and Dec. 31, 2023.

How much can class members receive?

Each eligible class member who submits a valid claim form can receive a cash payment of $25.

In addition to the cash payment, all class members automatically receive a code to enroll in Privacy Shield Pro. This code is located at the top of the settlement notice they received. Enrollment in Privacy Shield Pro is optional.

How to claim a class action revate

Class members can file a claim online or download, print and fill out the PDF claim form and mail it to the settlement administrator.

Required information

To file an online claim, class members must log in with their notice ID and PIN, which is located on the notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator by emailing info@WMHSettlement.com or calling 833-417-4891 and providing their full name and mailing address.

Settlement fund breakdown

When is the Witham Memorial Hospital settlement payout date?

The settlement administrator will distribute payments approximately 24 days after the court approves the settlement.

Why is there a class action settlement?

The class action lawsuit alleged Witham Memorial Hospital disclosed patients’ confidential PII and/or PHI to third parties without patient consent.

The hospital denies these allegations, and both parties agreed to settle to avoid the expense, burden and uncertainty of continued litigation.
