Teleflora $6M Unwanted Text Messages Class Action Settlement

Individuals who received more than one promotional text message from Teleflora while the National Do Not Call Registry listed their phone number may be eligible to submit a claim for up to $251 from a class action settlement. The settlement class includes approximately 23,844 telephone numbers.

Teleflora LLC agreed to pay $6 million to settle a class action lawsuit alleging violated federal law by sending telemarketing text messages to individuals whose numbers the National Do Not Call Registry listed.

Who can file a claim for a TCPA payout?

Class members must meet the following criteria:

  • They did not provide their telephone number to Teleflora.
  • They received more than one text message from Teleflora promoting its goods or services within a 12-month period since May 9, 2021.
  • They registered their residential or cellular telephone number with the National Do Not Call Registry for at least 30 days before receiving at least two text messages from Teleflora within a 12-month period.

How much are settlement payments?

Cash payment: Class members can submit a claim to receive a cash payment of up to $251 from the net settlement fund.

How to claim an award

To receive a settlement payment, class members can file a claim online or print and complete the PDF claim form, and mail it to the settlement administrator.

Required claim information

  • To submit a claim, class members must provide the phone number(s) that received two or more qualifying promotional text messages from Teleflora.
  • To submit a claim online, class members must provide the claim ID number and confirmation code from the settlement notice they received.
  • To submit a claim by mail, class members must provide the claim ID number from the settlement notice they received.

Settlement fund breakdown

The $6,000,000 settlement fund will include:

  • Settlement administration costs: Up to $61,446
  • Attorneys' fees: Up to $2,000,000
  • Attorneys' expenses: Not to exceed $20,000
  • Payments to eligible claimants: Remaining settlement funds

When is the Teleflora TCPA settlement payout date?

The settlement administrator will mail payments to approved claimants after it completes claim processing and the court grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged that Teleflora violated the Telephone Consumer Protection Act and the Virginia Telephone Privacy Protection Act by sending telemarketing text messages to individuals whose numbers were on the National Do Not Call Registry without their consent. Teleflora denies any wrongdoing, however agreed to settle to avoid the risk and expense of continued litigation.
