System Pavers $350,544 Data Breach Class Action Settlement

Individuals who received notice that the System Pavers LLC data breach that occurred between Sept. 20, 2024, and Oct. 4, 2024, may have compromised their personal information could be eligible to claim up to $3,000 from a class action settlement.

System Pavers agreed to pay $350,544 to settle a class action lawsuit alleging it failed to protect sensitive personal information, including names and Social Security numbers, did not use reasonable data security measures and delayed notifying affected individuals about the breach.

Who can file a claim for a data breach settlement?

Class members are individuals residing in the United States, including current and former employees, as well as any other individuals whose data System Pavers stored in the affected systems the breach potentially compromised. This includes those who received notification that the data breach may have compromised their personal information.

How much are settlement payments?

Class members have the following benefit options:

• Documented losses: Class members can claim up to $3,000 per person for documented and unreimbursed monetary losses from fraud or identity theft the data breach caused. Examples of covered expenses include fees for credit reports, credit monitoring, freezing/unfreezing credit, costs to replace IDs and postage to contact banks by mail.
• Lost time: Class members can claim up to four hours at $20 an hour ($80 maximum) for time spent dealing with the data breach. This payment is included in the $3,000 cap for documented losses.

• Alternative cash payment: Class members who do not submit a claim for documented losses or lost time can submit a claim to receive a one-time pro rata cash payment. This is estimated at $100 for California residents and $80 for residents of other states. The settlement administrator will determine the final amount by the total number of claims filed.
• Credit monitoring: All class members are eligible to enroll in three years of CyEx Financial Shield Complete, which includes $1 million in financial fraud insurance and monitoring for identity theft, unauthorized transactions and high-risk financial activity. If the program detects suspicious activity, class members will have access to a fraud resolution agent.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or download and print the PDF claim form, complete it and submit it to the settlement administrator by mail or email. To file an online claim, class members must provide the notice ID and confirmation code from the personalized notice they received.
