Anyone who received notice that their personal information may have been accessed during the Saint Xavier University data breach between June 29, 2023, and July 18, 2023, may qualify to claim up to $5,000 from a class action settlement.

Saint Xavier University agreed to pay $1.75 million to settle a class action lawsuit alleging it failed to adequately protect the sensitive personal information of students, employees and others. The lawsuit claims a cyberattack exposed information such as Social Security numbers, financial account details, health data and other personal identifiers.

Who can file a Saint Xavier University claim?

Class members must meet the following criteria:

  • Their personal information was potentially accessed during the Saint Xavier University data incident that occurred between June 29, 2023, and July 18, 2023.
  • They received a notice from Saint Xavier University about the data incident OR
  • They have reason to believe their information was involved in the breach.

The affected groups include:

  • Current and former students of Saint Xavier University
  • Prospective students
  • Current and former employees
  • Dependents, spouses or beneficiaries of current and former employees and students

How much is the data breach payout?

  • Reimbursement for documented out-of-pocket losses: Up to $5,000 per person for unreimbursed expenses directly related to the data breach. Eligible expenses may include costs for identity theft protection, credit monitoring, bank fees, postage, notary services, etc.
  • Cash payment: Class members who do not have documented out-of-pocket losses may opt for a cash payment estimated at $75. The final amount will depend on the number of valid claims and the remaining funds after other payments are made.
  • Credit monitoring and insurance services: Regardless of whether a class member claims reimbursement or a cash payment, they may choose to receive two years of credit monitoring and up to $1 million in identity theft insurance at no cost.

If there are funds left over after the initial distribution and the average subsequent payment would be at least $3 per person, additional payments may be made to claimants who cashed or deposited their initial payment.

How to claim a class action rebate

Class members can file a claim online or download, print, complete and mail the PDF claim form to the settlement administrator. The claim deadline is Oct. 6, 2025.

Is proof or documentation required to submit a claim?

To file a claim, class members must provide the unique ID located on the settlement notice they received. Online claimants must also provide the PIN from the same notice. Those who are unable to locate their ID & PIN should contact the settlement administrator at info@SXUSettlement.com.

For reimbursement of out-of-pocket losses, class members must provide reasonable documentation, such as receipts or bills, that demonstrates the loss was most likely caused by the data incident. Self-prepared documents like handwritten receipts alone are not sufficient but may be used to clarify other documentation.

Cash payment or credit monitoring claims do not require proof or documentation.

$1.75 million settlement fund breakdown
