Sportsman's Warehouse $4.5M Privacy Violation Settlement

Individuals who lived in Pennsylvania and ordered and reserved a firearm online from Sportsman’s Warehouse between Jan. 1, 2020, and March 13, 2024, may qualify to submit a claim for up to $107 from a class action settlement.

Sportsman’s Warehouse Inc. and Sportsman’s Warehouse Holdings Inc. agreed to pay up to $4,500,000 to settle a class action lawsuit. The plaintiff claimed the companies shared information about online firearm purchases with third parties without customer consent in violation of Pennsylvania privacy and firearms laws.

Who can file a claim?

Class members must meet the following criteria:

  • They reside in Pennsylvania.
  • They ordered and reserved a firearm from www.sportsmans.com for pickup and purchase in-store.
  • They placed the order between Jan. 1, 2020, and March 13, 2024.

How much are settlement payments?

Pro rata cash payment: Class members can submit a claim to receive a cash payment up to $107. The settlement administrator will determine the final payment amount by the total number of claims filed.

How to claim a settlement payout

To claim a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Sportsman's Warehouse $4.5 million settlement fund

The $4,500,000 settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys’ fees and expenses: Up to $1,575,000
  • Service award to class representative: Up to $5,000
  • Payments to eligible class members: Remaining settlement funds

  • Final approval hearing: July 31, 2026

When is the Sportsman’s Warehouse settlement payout date?

The settlement administrator will issue payments to approved claimants approximately 75 days after the court grants final approval of the settlement.

Why is there a class action settlement?

This class action lawsuit alleged Sportsman’s Warehouse shared information about firearm purchases made on its website with third parties without customer consent. The lawsuit claimed violations of the Pennsylvania Wiretapping and Electronic Surveillance Control Act and the Pennsylvania Uniform Firearms Act.

Sportsman’s Warehouse denies the allegations but agreed to settle to avoid the risks and expense of further litigation and a possible trial.
