Current and former tenants who lived in the Skyline Apartments at 753 James St., Syracuse, New York, for at least one month between Jan. 1, 2017, and July 14, 2023, may be eligible to submit a claim for a cash payment from a class action settlement.

Green Skyline Apartments LLC agreed to settle a class action lawsuit alleging breaches of the warranty of habitability. The plaintiffs claimed the the lobby, elevators, hallways, stairwells and other common areas within the Skyline apartment building located in Syracuse were unsafe.

Who can file a claim for a settlement payout?

Class members are individuals who resided in the Skyline Apartments at 753 James St., Syracuse, NY 13203 for at least one month between Jan. 1, 2017, and July 14, 2023.

How much are settlement payments?

Pro rata cash payment: Class members can submit a claim to receive an allocated share of up to $22,275 from the net settlement fund. The settlement administrator will determine cash payment amounts by the number of months the class members resided in the apartment building and total number of claims filed.

How to claim a class action rebate

To receive a settlement payment from the settlement, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

The claim deadline is Aug. 8, 2026. If the settlement administrator remails a notice to a class member due to an address issue, the deadline is 45 days from the second mailing.

Required proof and claim information

  • Online claims require the CPT ID and passcode from the settlement notice they received.
  • All class members must provide their apartment number and number of months they resided at Skyline Apartments.
  • They must also provide two forms of the following supporting documentation showing their Skyline apartment address during the qualifying period:
    • Utility bill
    • Lease agreement
    • Driver’s license
    • Tax return
    • W-2 form
    • Voter registration
    • Vehicle registration
    • Bank statement

  • Paper check mailed to the address provided (only option for mailed claims)
  • Electronic payment

Settlement fund breakdown

The $800,000 settlement fund will include:

  • Settlement administration costs: Up to $50,000
  • Attorneys' costs and expenses: $5,000
  • Service award to class representatives: $5,000 each
  • Payments to approved claimants: Remaining settlement funds

Class counsel, Legal Services of Central New York Inc., waived attorneys’ fees and only seeks reimbursement for actual costs and expenses.

When is the Skyline Apartments tenant settlement payout date?

The settlement administrator will issue payments to approved claimants approximately 65 days after the court grants final approval of the settlement.

Why was there a class action settlement?

The class action lawsuit alleged Green Skyline Apartments LLC failed to maintain the common areas of the Skyline Apartments in a habitable condition, which would violate the warranty of habitability under New York law. The plaintiffs claimed that conditions in the lobby, elevators, hallways, stairwells and other shared spaces were dangerous for tenants and the company did not address complaints.

Green Skyline Apartments LLC denied the allocations but agreed to settle to avoid the cost and uncertainty of ongoing litigation and a possible trial.
