
Consumers who received more than one telephone solicitation call from Sirius XM between April 27, 2019, and Oct. 31, 2025, may qualify to claim a cash payment of up to $1,500 from a class action settlement that is pending preliminary approval in federal court.
Sirius XM Radio agreed to pay $28,000,000 to settle a class action lawsuit alleging it made telephone calls to individuals registered on the National Do Not Call Registry or Sirius XM’s own internal do not call registry. Counsel filed a motion for preliminary approval of the settlement on Oct. 3, 2025.
Who is eligible for a SiriusXM TCPA payout?
The settlement class includes the following consumers:
- Individuals in the United States who, between April 27, 2019, and Oct. 31, 2025, received more than one telephone sales call in a 12-month period on their landline, wireless, cell or mobile telephone number by or on behalf of Sirius XM.
- The recipient of the call was not a self-paying Sirius XM subscriber at the time of the first call or before the start of the second call.
- The recipients received the call more than 31 days after they registered their telephone number with the National Do Not Call Registry.
OR
- Individuals in the United States who, between April 27, 2019, and Oct. 31, 2025, received more than one telephone sales call in a 12-month period on their landline, wireless, cell or mobile telephone number by or on behalf of Sirius XM.
- The recipients received the sales calls after asking to register their telephone number on Sirius XM’s internal do not call list.
How much is the class action settlement payment?
Pro rata cash payment: Each approved claimant will receive a pro rata cash payment of up to $1,500 from the net settlement fund. The settlement administrator will determine the final payment amount by the number of claims filed.
How to claim a TCPA class action rebate
To receive a settlement payment, eligible class members must submit a claim form. Class members can file a claim online or download a PDF claim form to print, complete and mail to the settlement administrator.

The settlement administrator will establish a website and determine the claim deadline after the court grants preliminary approval of the settlement.
Required claim information
- All class members must provide the telephone number that received the SiriusXM sales calls.
- To submit a claim online or by mail, class members must provide the notice ID from their official settlement notice.

$28 million SiriusXM TCPA settlement fund
The settlement fund of $28,000,000 will cover:
- Settlement administration costs: To be determined
- Attorneys' fees: Up to $9,333,333
- Attorneys' expenses: Up to $300,000
- Service awards to class representatives: Amount to be determined and presented to the court for approval at a later date
- Payments to eligible class members: Remaining settlement funds
Estimated settlement timeline
- Class counsel delivers class member list to the settlement administrator: Dec. 1, 2025-Dec. 16, 2025
- Sirius XM to pay the settlement fund: Jan. 15, 2026 or 10 days after the court grants preliminary approval, whichever is later
- Settlement website and toll-free number operational: Jan. 15, 2026, or 10 days after the court grants preliminary approval, whichever is later
- Notice issued to class members by email or postcard: 15 days after the settlement administrator receives the class member list
- Claim deadline: No later than 40 days prior to final approval hearing
- Final approval hearing: Preferably the week of March 31, 2026, or later
When is the Sirius XM class action payout date?
The settlement administrator will issue payments to approved claimants approximately 60 days after it resolves appeals and the court grants final approval of the settlement.
Why did this class action settlement happen?
This class action lawsuit alleged Sirius XM made telephone solicitation calls to individuals registered on the National Do Not Call Registry or Sirius XM’s own internal do not call registry. The plaintiffs claimed these calls violated federal and state telemarketing laws.
Sirius XM denies any wrongdoing but agreed to the settlement to avoid the cost and uncertainty of continued litigation and the possibility of a trial. As part of the settlement, SiriusXM also agreed to implement certain business practices related to outbound telemarketing calls to consumers.
