Shannondell $4.4 Million Entrance Fee Refund Settlement

Former residents of Shannondell at Valley Forge or their representatives whose entrance fee refund the company reduced due to refurbishment or restoration costs may be eligible to claim a cash payment from a class action settlement.

Shannondell Inc. and Dell Management Services Inc. agreed to pay $4.4 million to resolve a class action lawsuit alleging they improperly deducted refurbishment and restoration costs from entrance fee refunds owed to former residents under their residence and care agreements.

Who can file a claim?

Class members must meet the following conditions:

  • They are a former resident of Shannondell at Valley Forge who had a residence and care agreement or a legal representative, executor, administrator or heir of a deceased former resident who would have been eligible.
  • Shannondell reduced their entrance fee refund by costs for refurbishment and restoration of their unit.

How much is the class action payout?

The amount each eligible class member receives depends on several factors, including:

  • The total number of valid claims submitted
  • The amount deducted from each class member's entrance fee refund for refurbishment and restoration
  • Deductions for court-approved administrative costs, attorneys' fees and expenses, and a service award to the class representative

The settlement administrator will distribute the fund on a proportional basis, meaning the more Shannondell deducted from the class member's entrance fee refund, the larger their share of the settlement.

How to claim a settlement payment

Class members can file a claim form by mail or email. There is no online claim portal. They must download the PDF claim form, fill it out and submit it to the settlement administrator by June 2, 2026.

Required proof

Individuals filing on behalf of a deceased resident must confirm their authority to do so. This means they must be:

  • The executor (if the decedent had a will admitted to probate) or acting on behalf of the executor
  • The administrator (if the decedent died without a will and probate court took out letters of administration) or acting on behalf of the administrator
  • An heir of the deceased person or acting on behalf of an heir if the decedent died without a will and probate court did not file formal proceedings

These individuals must also agree to distribute any settlement payment to all individuals entitled to a portion and to indemnify the class and related parties against improper payment claims.

$4.4 million settlement fund

The $4,400,000 settlement fund covers:

  • Attorneys' and litigation costs and class administration fees: Up to $120,000
  • Attorneys' fees: Up to $1,465,000
  • Service award to class representative: Up to $15,000
  • Payments to eligible class members: Remainder of the fund

When is the Baer v. Shannondell Inc. payout date?

The settlement administrator will issue payments approximately 60 days after the court resolves any appeals and grants final approval of the settlement.

Why is there a class action settlement?

The class action lawsuit alleged Shannondell Inc. breached its residence and care agreement by deducting certain refurbishment and restoration costs from the entrance fee refunds it owed to former residents.

Shannondell denies these claims, but the parties agreed to settle to avoid the risks and costs of continued litigation and provide relief to class members.
