Update: The San Diego Fertility Center Medical Group and Ivy Fertility Services settlement received final approval on Aug. 27, 2025. The settlement administrator expects to mail payments after Sept. 29, 2025.
Consumers who visited certain fertility clinic websites between Jan. 1, 2020, and April 4, 2025, may be eligible to claim a cash payment from a class action settlement.
San Diego Fertility Center Medical Group Inc. and Ivy Fertility Services LLC agreed to pay $850,000 to settle a class action lawsuit alleging privacy violations. The lawsuit claimed these companies improperly shared website users' personally identifiable device information in violation of their privacy policies and applicable laws.
Who qualifies for a privacy class action payment?
Class members must meet the following criteria:

How much is the class action rebate?
Pro rata cash payment: Each approved claimant will receive a cash payment. The settlement administrator will determine the payment amount by the number of claims filed.
How to claim a settlement payout
To claim a settlement payment, class members must submit a claim form by the June 24, 2025 deadline.
- To file a claim online, access the online claim form through the settlement website.
- To submit a claim by mail, download and print the PDF claim form to mail it to the settlement administrator.

$850,000 class action settlement fund breakdown
The settlement fund of $850,000 will include the following payments:

- Attorneys' fees: Up to $283,333.33
- Attorneys' expenses: To be presented to the court at a later date
- Service awards to the class representative: $2,500
- Payments to approved claimants: The remainder of the settlement fund

When is the fertility website privacy settlement payout date?
The settlement administrator will issue payments to class members with valid claims approximately 60 days after the court grants final approval of the settlement.
Why is there a class action settlement?
The class action lawsuit alleged San Diego Fertility Center Medical Group Inc. and Ivy Fertility Services LLC shared personally identifiable device information of website users, violating their privacy policies and the law. The defendants deny all allegations of wrongdoing and maintain they did not share any patient records or personal medical information.
All parties involved agreed to settle to avoid the costs further litigation and a trial.
