Individuals who received two or more text messages about Keller Williams Realty Landmark at a phone number registered on the National Do Not Call Registry may be eligible to claim a cash payment from a class action settlement.

Bayside NY Homes LLC, doing business as Keller Williams Realty Landmark, agreed to pay $400,000 to resolve a class action lawsuit alleging it sent telemarketing text messages to numbers on the National Do Not Call Registry in violation of federal law.

Who can file a claim?

Class members must meet the following criteria:

  • They are associated with one of 1,019 unique telephone numbers identified in records.
  • Deirdre Folan, on behalf of Keller Williams Realty Landmark, sent more than one text message to that number within any 12-month period between June 24, 2020, and Dec. 15, 2025.
  • They registered their telephone number on the National Do Not Call Registry at least 30 days before the Keller Williams Realty Landmark text messages.

How much can class members receive?

Pro rata payment: The total settlement fund is $400,000. After deducting settlement administration costs, attorneys’ fees and a service award to the class representative, the settlement administrator will divide the remainder equally among class members who submit valid claims.

Each eligible telephone number counts as one claim.

How to claim a settlement payment

Class members can file a claim online or download, print and complete the PDF claim form and mail it to the settlement administrator.

Proof or documentation required

  • All claimants must provide the notice ID located on the settlement notice they received. Online claimants must also provide the confirmation code from the same notice. Those who do not have their ID or code or who misplaced theirs should contact the settlement administrator.
  • All claimants must also provide their contact information, including the the telephone number in which they received the text messages.

$400,000 million settlement fund

The $400,000 settlement fund covers:

  • Settlement administration costs: To be determined
  • Attorneys’ fees: Up to $133,333.33
  • Attorneys’ costs and expenses: To be determined
  • Service award to class representative: Up to $5,000
  • Payments to eligible class members: Remaining funds

Important dates

  • Deadline to file a claim: March 16, 2026
  • Exclusion (opt-out) deadline: March 16, 2026
  • Final approval hearing: April 15, 2026

When is the Bayside NY Homes LLC TCPA settlement payout date?

The settlement administrator will issue payments to approved claimants approximately 60 days after the court resolves any appeals and grants final approval to the settlement.

Why is there a class action settlement?

The class action lawsuit alleged that Bayside NY Homes LLC, doing business as Keller Williams Realty Landmark, sent telemarketing text messages to phone numbers on the National Do Not Call Registry without proper consent and in violation of the Telephone Consumer Protection Act.

The company denied all wrongdoing and liability. Both sides agreed to settle to avoid the cost and uncertainty of further litigation and trial. The court has not decided who is right.
