Individuals who received a notice stating the October 2024 Rumpke data incident may have involved their private information may be eligible to submit a claim for up to $5,000 and other benefits from a class action settlement.

Rumpke Consolidated Companies Inc. agreed to pay $750,000 to settle a class action lawsuit alleging it failed to implement reasonable security measures to protect sensitive personal information, resulting in unauthorized access to private information. Rumpke denies any wrongdoing but agreed to settle to avoid the expense and uncertainty of continued litigation.

Who can file a claim?

Class members are individuals in the United States whose private information the October 2024 Rumpke data incident allowed unauthorized individuals to access or acquire and who received notice of the incident from Rumpke or the settlement administrator.

How much can class members get?

Class members have the following options:

  • Cash payment A – Documented losses: Class members can claim up to $5,000 for actual, documented out-of-pocket losses the data incident caused, including unreimbursed expenses and lost time spent addressing issues related to the incident. Claimants must provide reasonable third-party documentation showing the losses are fairly traceable to the data incident. Self-prepared documents alone are not sufficient.
  • Cash payment B – Alternate cash payment: Class members who do not submit a documented losses claim may submit a claim to receive a pro rata cash payment. Based on current estimates, the payment is expected to range between approximately $237.50 and $475, depending on the number of valid claims filed and the funds remaining after settlement expenses.
  • Credit monitoring services: All class members who submit a claim form may elect to enroll in one year of three-bureau identity theft and credit monitoring services.

The settlement administrator will distribute settlement funds after it pays settlement administration costs, attorneys’ fees and expenses, and service awards to class representatives. If the number of valid claims exceeds the available funds, the settlement administrator will reduce all cash payments on a pro rata basis.

How to claim a Rumpke data breach class action payment

To receive a settlement payment or credit monitoring services, class members can file a claim online or download, print and complete the PDF claim form to complete and mail to the settlement administrator. The claim deadline is March 19, 2026.

Required proof and claim information

  • For all claims, class members must provide their contact information and required claim identification information, including their class member ID and PIN.
  • For documented out-of-pocket loss reimbursement, class members must provide reasonable third-party documentation of actual, unreimbursed losses fairly traceable to the data incident. Self-prepared documents alone are not sufficient but may supplement other documentation.
  • For alternate cash payments and credit monitoring services, class members do not need to submit documentation of losses but must attest to their eligibility and submit the claim form.

When is the Rumpke data breach class action settlement payout date?

The settlement administrator will issue payments and provide credit monitoring enrollment instructions after the court resolves any appeals and the grants final approval to the settlement.

Why is there a class action settlement?

This class action lawsuit alleged the October 2024 Rumpke data incident compromised Rumpke computer systems, allowing unauthorized parties to access files containing private information such as names, dates of birth, Social Security numbers and other sensitive data. The plaintiffs claimed Rumpke failed to adequately protect this information.

Rumpke denies any wrongdoing but agreed to settle to avoid the expense and uncertainties of ongoing litigation.
