
California residents who visited the Pomona Valley Hospital Medical Center website and logged into the patient portal between Jan. 1, 2019, and Dec. 31, 2022, may qualify to receive a cash payment from a class action settlement.
Pomona Valley Hospital Medical Center agreed to pay $600,000 to settle a class action lawsuit alleging its use of the Facebook pixel and similar technology on its public website resulted in unauthorized disclosure of patient portal usage data, potentially violating wiretapping and other statutes.
Who are the class members?
Class members must meet all of the following criteria:
- They were California residents at any time between Jan. 1, 2019, and Dec. 31, 2022.
- They visited the Pomona Valley Hospital Medical Center website (https://pvhmc.org).
- They logged into the patient portal during the specified period.
The settlement administrator will use Pomona Valley Hospital Medical Center's records to identify eligible class members.
How much can class members get?
Pro rata payment: Each participating class member will receive a pro rata cash payment from the net settlement fund. The exact amount will depend on the number of eligible class members who do not opt out, as well as deductions for administrative expenses, attorneys’ fees, service awards and taxes.
No action needed to receive payment
Class members do not need to file a claim to receive a payment. Eligible class members who do not opt out will automatically receive a settlement payment.
Class members will receive a paper check mailed to their last known address unless they complete the online payment election form and select their preferred payment method. To complete the form, they must log in using the unique ID from their settlement notice.
Those whose contact information has changed should update it with the settlement administrator as soon as possible to ensure they receive payment.

The $600,000 settlement fund covers:

- Attorneys’ fees and expenses: Up to $200,000
- Service award to class representative: Up to $3,500
