
Consumers who received notice that their personal information was impacted by the July 7, 2022, ProSmile Holdings LLC data breach may be eligible to claim up to $5,500 from a class action settlement.
ProSmile Holdings LLC agreed to pay $440,000 to resolve a class action lawsuit alleging a targeted cyberattack on its computer systems exposed sensitive personal and health information. This includes:
- Names
- Dates of birth
- Social Security numbers
- Driver’s license numbers
- Financial account numbers
- Payment card numbers
- Medical treatment details
- Diagnoses or clinical information
- Provider information
- Prescription information
- Health insurance information
Who is eligible for a ProSmile Holdings payout?
Individuals are considered class members if they meet the following criteria:
- They are residents of the United States.
- Their personal, health or financial information was potentially exposed to unauthorized third parties as a result of the July 7, 2022, ProSmile Holdings LLC data breach.
- They received direct notice from ProSmile or the settlement administrator, which included a unique notice ID, indicating their information may have been impacted.
How much is the data breach payment?
- Documented out-of-pocket losses: Up to $5,000 for documented out-of-pocket losses related to the data breach. These include:
- Unreimbursed losses from fraud or identity theft
- Professional fees (such as attorneys or accountants)
- Costs to freeze or unfreeze credit
- Credit monitoring costs incurred after Nov. 9, 2023
- Other reasonable expenses, such as postage
- Social Security number impact payment: Class members who received notification that their Social Security number was exposed in the breach may elect to receive a payment of up to $500 instead of the pro rata cash payment. This amount may be reduced depending on the number of claims and available funds.
- Pro rata cash payment: Based on the number of valid claims and the funds remaining after paying documented losses and Social Security number impact payments.
Class members may claim both documented out-of-pocket losses and either a pro rata cash payment or, if eligible, a Social Security number impact payment (but not both).
Payments will be distributed in the following order:
- Documented out-of-pocket losses
- Social Security number impact payments
- Pro rata cash payments
How to claim a data incident class action payment
Class members can submit the online claim form or download, print and complete the PDF claim form to mail to the settlement administrator. The deadline to file a claim is Sept. 25, 2025.

Is proof or documentation required to submit a claim?
- All claimants must provide the Notice ID located on the settlement notice they received.
- Online claimants must also provide the PIN from that notice. Those who are unable to locate their notice ID and PIN should contact the settlement administrator at info@ProSmileSettlement.com.
- For documented out-of-pocket losses, class members must provide supporting documentation (e.g., receipts, account statements, bill, etc.)

$440,000 cybersecurity settlement fund breakdown
The $440,000 settlement fund covers:
- Settlement administration costs: To be determined
- Attorneys' fees: Up to $146,666.67
- Attorneys' costs: Up to $25,000
- Service award to class representative: $5,000
- Payments to eligible class members: Remaining funds after the above deductions

When is the ProSmile Holdings LLC payout date?
Settlement payments will be distributed approximately 31 days after the court grants final approval and any appeals are resolved.
Why did this class action settlement happen?
The class action lawsuit alleged a cyberattack on ProSmile Holdings LLC’s systems resulted in unauthorized access to files containing sensitive personal and health information. The plaintiff claimed ProSmile failed to adequately protect this data.
The parties agreed to settle to avoid the costs, risks and uncertainties of continued litigation. ProSmile denies any wrongdoing.
