Individuals residing in the United States during the September 2021 Pawn America data breach, whose private information may have been compromised, may qualify to submit a claim for up to $5,000 from a class action settlement. The cybersecurity incident impacted an estimated 679,604 current and former customers.

Pawn America Minnesota LLC, Payday America Inc., and PAL Card Minnesota LLC, collectively, Pawn America, have agreed to pay $3.19 million to settle a class action lawsuit. The plaintiffs claimed that Pawn America was responsible for a data breach in September 2021, during which an unauthorized third party accessed files containing sensitive customer information, including names, Social Security numbers, driver’s license numbers, passport numbers, government identification numbers, dates of birth, and financial account information.

Who can file a claim for a data breach payout?

Class members must meet the following criteria:

  • They were residing in the United States at the time of the September 2021 Pawn America data breach.
  • Their private information was potentially compromised as a result of the data breach.
  • They may received a notification from Pawn America about the data breach.

How much are settlement payments?

Class members have the following benefit options:

  • Documented loss payment: Class members can claim up to $5,000 in out-of-pocket expenses or other losses traceable to the data breach. This may include unreimbursed fraudulent charges, identity theft losses, professional fees, costs to freeze or unfreeze credit, credit monitoring costs and other miscellaneous expenses.
  • Classwide cash payment: All class members can also submit to receive a cash payment, estimated at $30. Final payment amount will be determined by the total number of claims filed.
  • California cash payment: Class members residing in California in September or October 2021 can submit a claim for an additional cash payment, estimated at $50. Final payment amount will be determined by the total number of claims filed.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to mail to the settlement administrator.

$3.19 million settlement fund

The $3,185,000 settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys' fees: Up to $1,061,666.67
  • Attorneys' expenses: Up to $50,000
  • Service awards to class representatives: $4,000 each, $20,000 total
  • Payments to approved claimants: Remaining settlement funds

When is the Pawn America data breach settlement payout date?

Payments will be issued to approved claimants approximately 90 days after the court grants final approval of the settlement.
