Individuals who received a notification stating the June 2024 cyberattack against Ott Cone & Redpath PA may have compromised their private information may qualify to submit a claim for up to $2,500 from a class action settlement.

Ott Cone & Redpath PA agreed to pay $600,000 to settle a class action lawsuit alleging cybercriminals gained unauthorized access to its network in June 2024. The breach potentially exposed the personal and protected health information of approximately 34,457 people.

Who is eligible for a data breach payout?

Class members are individuals who received a notification from Ott Cone & Redpath PA informing them their personal and protected data may have been compromised in the June 2024 data breach.

How much is the class action settlement payment?

Class members can submit a claim to receive one or more of the following benefits:

  • Expense reimbursement: Claimants may submit a claim to receive up to $2,500 for documented, unreimbursed out-of-pocket losses resulting from the data breach. Eligible expenses includes fees to obtain credit reports and freezing or unfreezing, card replacement fees, late or over-limit fees, bank or credit card fees and the cost for up to one year of credit monitoring or identity theft insurance purchased after June 3, 2024, and before the settlement effective date.
  • Alternative cash payment: Class members who do not submit for expense reimbursement can submit to receive a cash payment of up to $50. The settlement administrator will determine the final payment amount by the number of claims filed.
  • Credit monitoring: All class members can elect to receive three years of one-bureau credit monitoring services.

How to claim a class action rebate

To receive a settlement payment, class members must submit a claim form by the Dec. 10, 2025, deadline. Class members can file a claim online or print a PDF claim form to mail to the settlement administrator.

Required proof and claim information

  • To submit an online claim, class members must provide the CPT ID and passcode from the official settlement notice they received.
  • Expense reimbursement claims require supporting documentation, which may include receipts, bank or credit card statements and invoices showing fees paid.

Payout options

Class members can choose from the following payment options:

  • PayPal
  • Venmo
  • Direct deposit
  • Paper check mailed to the address provided (only option available for mailed claim forms)

$600K data breach settlement fund

The $600,000 settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys' fees and expenses: Up to $200,000
  • Service awards to class representatives: $2,500 each for two plaintiffs ($5,000 total)
  • Credit monitoring services: Cost determined by the number of claims filed
  • Payments to approved claimants: Remaining settlement funds

  • Final fairness hearing: Dec. 15, 2025

When is the McKoy v. Ott Cone & Redpath PA payout date?

The settlement administrator will issue payments to approved claimants 30 days it approves the claim or 75 days after the court grants final approval of the settlement, whichever is later.
