Current and former patients who received notification that the May 2025 Naper Grove Vision Care data breach may have affected their private information could qualify to submit a claim for up to $1,000 from a class action settlement. The cybersecurity incident compromised the data of 20,093 individuals.

Naper Grove Vision Care P.C. agreed to settle a class action lawsuit alleging a targeted cyberattack compromised certain files containing private information. The plaintiffs claimed the data breach impacted personally identifiable information and protected health information, including names, Social Security numbers and medical records.

Who can file a claim for a data breach payout?

Class members are individuals whose private information the May 2025 Naper Grove Vision Care data breach may have impacted.

How much are settlement payments?

Class members may claim one of two types of cash payments in addition to free credit monitoring.

  • Cash payment A – documented losses: Class members can claim up to $1,000 for documented and unreimbursed out-of-pocket losses that occurred between May 24, 2025, and Sept. 18, 2026, as a result of fraud or identity theft traceable to the data breach. Eligible expenses include fees for credit reports, credit monitoring or freezing/unfreezing credit; costs to replace IDs; and postage to contact financial institutions.
  • Cash payment B – alternate cash: Class members who do not submit a documented losses claim can submit a claim to receive a one-time pro rata cash payment from a $50,000 fund. The settlement administrator will determine the final payment amount by the number of claims filed.
  • Credit monitoring: All class members can elect to enroll in one year of CyEx Medical Shield Complete, which includes $1 million in medical identity theft insurance and monitoring for health care insurance ID and medical record number exposure, unauthorized health savings account spending and access to fraud resolution agents.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Required proof and claim information

  • Online claims require the login ID and PIN from the settlement notice the class member received.
  • Documented losses claims require supporting documentation, such as receipts, bank or credit card statements showing unreimbursed fees or fraudulent charges or other proof of identity theft or fraud.

When is the Naper Grove data breach settlement payout date?

The settlement administrator will issue payments to approved claimants after it completes claim processing or 90 days after the court grants final approval of the settlement, whichever is later.

Why is there a class action settlement?

This class action lawsuit claimed a targeted cyberattack compromised Naper Grove Vision Care P.C.’s computer systems in May 2025. The plaintiffs alleged the breach exposed files containing PII and PHI belonging to current and former patients.

Naper Grove denies the allegations but agreed to settle to avoid the expense and risk of continued litigation.
