MNGI Digestive Health $2.84M Data Breach Settlement

Consumers who received a notice from MNGI Digestive Health P.A. about an August 2023 data breach may qualify to claim up to $10,000 from a class action settlement.

MNGI Digestive Health P.A. agreed to pay $2,838,749.62 to settle a class action lawsuit alleging negligence, breach of implied contract, unjust enrichment, breach of fiduciary duty and violations of various Minnesota laws following a data breach that potentially exposed sensitive personal and medical information. These information may include a patient's:

• Full name
• Date of birth
• Passport number
• Driver’s license or state identification number
• Medical information
• Health insurance information
• Payment card information
• Account numbers
• Social Security number

Who can file an MNGI Digestive Health claim?

Class members must have received a direct notification from MNGI Digestive Health P.A. about the data breach that occurred on or about Aug. 20, 2023.

How much is the data breach payout?

• Pro rata payment: The amount depends on the number of valid claims and the net settlement fund remaining after other payments. Class members who claim a pro rata payment cannot also claim out-of-pocket losses.
• Out-of-pocket losses: Up to $10,000 per class member. Class members who claim a out-of-pocket losses cannot also claim a pro rata payment.
• Medical monitoring: Two years of free service from Medical Shield Pro by CyEx

How to claim a MNGI Digestive Health class action rebate

Class members can file a claim online or download, print and complete the PDF claim form to mail to the settlement administrator. The claim deadline is Sept. 4, 2025.

Proof and documentation required

For out-of-pocket reimbursement claims, class members must provide documentation, such as receipts, bank statements or other non-self-prepared documents, showing the expense and how it is related to the data incident. Handwritten receipts alone are not sufficient but can supplement other documentation. Eligible out-of-pocket expenses include:

• Costs resulting from identity theft or fraud (such as falsified tax returns)
• Fees for accessing or freezing/unfreezing credit reports
• Costs for credit or health care monitoring after Aug. 20, 2023
• Unpaid time off work to address issues related to the breach
• Miscellaneous expenses (notary, postage, mileage, etc.
