Individuals who received a notice stating the October 2024 McLean Mortgage Corp. data breach may have compromised their personal information could be eligible to claim up to $5,100 from a class action settlement.

McLean Mortgage Corp. agreed to settle a class action lawsuit claiming a cyberattack exposed sensitive customer data. This lawsuit alleged McLean Mortgage Corp. failed to adequately protect customer information, leading to unauthorized access to files containing names, Social Security numbers, driver’s license numbers, financial account numbers, passport numbers, health insurance information and other personal details.

Who can file a claim?

The official settlement website defines the class as all living persons residing in the United States whose personally identifiable information the data breach that occurred on or around Oct. 17, 2024, potentially compromised. This includes anyone who received a notice letter about the incident from McLean Mortgage Corp.

How much can class members get?

Class members may claim one or more of the following cash payment options:

  • Ordinary documented losses and expenses: Up to $1,000 for actual, documented and unreimbursed out-of-pocket expenses directly related to the data breach. Examples include fees for credit reports, credit monitoring, freezing or unfreezing credit or replacing IDs, and postage for contacting banks. This option requires documentation, such as receipts.
    • Reimbursement for lost time: Up to four hours at $25 per hour (maximum $100) for time spent addressing issues the data breach caused, such as changing passwords, investigating suspicious activity or researching the incident. Class members must provide a signed statement describing their efforts. Lost time claims count toward the $1,000 ordinary documented losses cap.
  • Extraordinary losses: Up to $4,000 for documented losses due to identity theft or fraud that the data breach directly caused. To qualify, class members cannot have received other reimbursement for the loss and must show they attempted to recover it through insurance or their financial institution. This option requires documentation, such as police reports or insurance claim documents.
  • Alternative cash payment: A one-time $45 payment for those do not wish to claim any of the above benefits. This option does not require documentation.

All class members are eligible for three years of CyEx Financial Shield Complete credit monitoring, which includes $1 million in financial fraud insurance.

How to claim a settlement payment

Class members can file a claim online or download a PDF claim form and mail it to the settlement administrator.

What proof or documentation is necessary to submit a claim?

  • For ordinary and extraordinary loss claims, class members must provide receipts, police reports, insurance claims or other supporting documents.
  • For lost time claims, class members must provide a signed statement describing their efforts.
  • For alternative cash payment claims, no documentation is needed.
  • For online claims, class members must provide their LoginID and PIN. They can find their LoginID and PIN on the notice they received. Those who are unable to locate their ID and PIN should email info@McLeanDataSettlement.com and provide their full name and mailing address.

  • Venmo (provide the phone number associated with the account)
  • Zelle (provide the email or phone number associated with the account)
  • Virtual prepaid card (provide an email to receive the card)

$250,000 settlement fund breakdown

The $250,000 settlement fund will cover:

  • Settlement administration costs: To be determined
  • Attorneys' fees and expenses: $250,000
  • Service awards to class representatives: Up to $2,500 each for three representatives ($7,500 total)
  • Payments to eligible class members: The remainder of the fund

When is the McLean data breach litigation payout date?

The settlement administrator will distribute payments after the court resolves any appeals and grants final approval of the settlement.

Why is there a class action settlement?

The class action lawsuit alleged a targeted cyberattack compromised McLean Mortgage Corp.’s computer systems in October 2024. The plaintiffs claimed McLean failed to adequately protect sensitive customer data, resulting in unauthorized access to personal information.
