Parents or guardians who received a bill from Presbyterian Healthcare Services for medical services related to their minor child’s treatment by Dr. Guy Rosenschein between Nov. 26, 2012, and Dec. 31, 2016, may be eligible to claim a cash payment from a class action settlement.

Presbyterian Healthcare Services agreed to pay $3,500,000 to resolve a class action lawsuit alleging it misrepresented Dr. Rosenschein’s qualifications and credentials while it employed him as a doctor or locum tenens.

Who are the class members?

Class members are all parents or guardians who received a bill for medical services related to their minor child’s treatment by Dr. Guy Rosenschein at Presbyterian Healthcare Services between Nov. 26, 2012, and Dec. 31, 2016, and received a postcard or email notice about the lawsuit.

How much is the Presbyterian Healthcare Services payout?

Pro rata payment: The settlement designates $2,465,000 of the total $3,500,000 fund for class member payments. Each eligible class member will receive an equal share of the settlement fund after deductions for attorneys’ fees, service awards to class representatives and administrative costs. The exact amount per person will depend on the total number of participating class members.

No claim form needed to receive payment

Class members do not need to file a claim to receive their share of the settlement. The settlement administrator will automatically mail a check to each class member’s last known address. Those who need to update their address should contact the claims administrator as soon as possible.

Payout options

The settlement administrator will mail checks to each class member's last-known address unless they submit an updated one. Class members must cash their checks within 150 days or the administrator will redistribute those funds to class members who did cash their checks.

$3.5 million settlement fund breaikdown

The $3,500,000 settlement fund includes:

  • Administrative costs: $60,000
  • Attorneys’ fees and costs: $875,000
  • Service awards to class representatives: $50,000 each ($100,000 total)
  • Payments to class members: $2,465,000

If any money remains after all payments and costs, the settlement administrator will donate them equally to Equal Access to Justice Inc. and Roadrunner Food Bank of New Mexico.

When is the McLarty v. Presbyterian Healthcare Services payout date?

The settlement administrator will mail payments within 21 days of the court's resolution of any appeals and final approval of the settlement.

Why is there a class action settlement?

The class action lawsuit alleged that Presbyterian Healthcare Services misrepresented Dr. Guy Rosenschein’s qualifications and credentials while it employed him as a pediatric surgeon and urologist. The plaintiffs claimed Presbyterian presented Dr. Rosenschein as a qualified and credentialed provider.

Presbyterian denies any wrongdoing or liability but agreed to settle to avoid the expense and uncertainty of continued litigation.
