
Individuals who received a written notification stating a data security incident involving Ems Linq LLC compromised their personal information between Sept. 12, 2023, and May 13, 2024, may be eligible to claim up to $3,000 from a class action settlement.
Ems Linq LLC agreed to settle a class action lawsuit alleging unauthorized access to the company's systems exposed the sensitive data, including names, addresses, dates of birth, bank account information and Social Security numbers, of employees and students of its school district customers.
Who can file a claim?
Individuals are considered class members if they received a written notification from Ems Linq LLC stating an unauthorized user potentially accessed, viewed or obtained their personal information as a result of the data security incident that occurred between Sept. 12, 2023, and May 13, 2024.
How much can class members receive?
- Documented ordinary losses: Up to $500 for eligible expenses, including unreimbursed bank fees, long-distance phone charges, cell phone charges (if charged by the minute), data charges (if charged by amount used), postage and gasoline for local travel as long as the class member incurred them between Sept. 12, 2023, and the claim deadline. The class member can include costs for credit reports, credit monitoring or identity theft insurance products.
- Documented extraordinary losses: Up to $2,500 for actual, documented and unreimbursed monetary losses the data security incident most likely caused that are not already covered under ordinary losses and occurred between Sept. 12, 2023, and the claim deadline. Claimants must show they exhausted all available insurance before claiming extraordinary losses. Documentation must be substantial and not self-prepared (e.g., receipts, account statements).
- Alternative cash payment: An estimated $50 payment in lieu of claiming documented ordinary or extraordinary losses.
- Credit monitoring: All class members can claim one year of credit monitoring services regardless of whether they claim monetary compensation.
How to claim a class action payment
Class members can file the online claim form or download and print the PDF claim form, complete it and mail it to the settlement administrator. They may also request a paper claim by phone or email from the settlement administrator. The claim deadline is June 29, 2026.

What proof or documentation is necessary to submit a claim?
- To file an online claim, class members must provide the unique ID and PIN from the settlement notice they received.
- To file an ordinary losses claim, class members must provide documentation such as bank or credit card statements or other proof of fees or charges; bills, receipts or other proof for telephone, internet, postage or gasoline expenses; and receipts or proof of purchase for credit reports, identity theft insurance or credit monitoring.
- To file an extraordinary losses claim, class members must provide substantial and plausible documentation (not self-prepared), such as receipts or account statements, and an attestation that the class member exhausted all applicable insurance policies.
- To file an alternative cash payment and/or credit monitoring claim, class members do not need to provide documentation.
Payout options
- Eligible class members who submit a claim by mail will receive a check by mail.
- Eligible class members who submit an online claim can choose a digital payment option, such as PayPal, Venmo or Zelle.
- The settlement administrator will send credit monitoring activation codes by mail or email.

When is the Ems Linq data breach settlement payout date?
The settlement administrator will distribute payments within 30 days of the date it approves the claim or 60 days after the court resolves any appeals and grants final approval of the settlement, whichever is later.
Why did this class action settlement happen?
The class action lawsuit alleged Ems Linq LLC discovered unauthorized access to its systems exposed the sensitive personal information of employees and students of its school district customers. The plaintiff claimed the company failed to adequately protect this information, resulting in the data security incident.
Ems Linq denies any wrongdoing but agreed to settle to avoid the cost, disruption and distraction of further litigation. As part of the settlement, the company agreed to make information security improvements.
