LifeScan Labs of Illinois, LLC has agreed to settle a class action lawsuit for alleged violations of Illinois’ Biometric Information Privacy Act (BIPA) and a data incident that impacted computer systems containing personally identifiable information. This settlement benefits individuals whose information was maintained on Lifescan’s computer systems and/or network that was impacted by the data incident, as well as those who used hand-scan timekeeping devices during their employment with Lifescan. Eligible class members can receive reimbursement for out-of-pocket losses, compensation for lost time, and automatic payments for BIPA violations.

Can I Claim an Award?

If you are a person whose information was maintained on Lifescan’s computer systems and/or network impacted by the data incident, you are eligible to claim an award. Additionally, if you used a hand-scan timekeeping device during your employment with Lifescan, you are also eligible. The settlement class includes approximately 85,360 members.

You are included in this settlement as a Data Incident Settlement Class member if your information was maintained on Lifescan’s systems affected by the data incident. For the BIPA Settlement Class, you must have used a hand-scan timekeeping device while employed by Lifescan.

  • Data Incident Settlement Class: Individuals whose information was maintained on Lifescan’s computer systems and/or network impacted by the data incident.
  • BIPA Settlement Class: Individuals who used hand-scan timekeeping devices during their employment with Lifescan.

What Can Class Members Claim?

Class members can claim various awards based on their eligibility:

Data Incident Settlement Class members can receive up to $3,000 for documented out-of-pocket losses and up to four hours of lost time reimbursed at $25 per hour. The combined total for out-of-pocket losses and lost time is capped at $3,000 per individual.

  • Documented Out-of-Pocket Losses: Up to $3,000 for actual, documented, and unreimbursed monetary losses caused by the data incident.
  • Lost Time Reimbursement: Up to four hours at $25 per hour for time spent remedying issues related to the data incident.

BIPA Settlement Class members will automatically receive a check for their share of the BIPA Settlement Fund, minus administrative costs, attorney fees, and service awards.

Is Proof Required to Claim the Reward?

Yes, proof is required for certain claims. Data Incident Settlement Class members must provide documentation for out-of-pocket losses. Acceptable documentation includes receipts or other non-self-prepared documents that verify the costs incurred. Self-prepared documents alone are insufficient.

  • Lost Time Reimbursement: An attestation and description of actions taken in response to the data incident.
