
Consumers who had a collections action filed against them by Las Cruces Medical Center or Faber & Brand after Dec. 28, 2022, may qualify to receive at least $625 from a class action settlement.
Las Cruces Medical Center LLC, doing business as Mountain View Regional Medical Center, agreed to pay $399,375 to settle a class action lawsuit alleging it initiated illegal collections actions, including lawsuits and wage garnishments, against certain patients.
Who is eligible for a Mountain View Regional Medical Center payout?
Consumers qualify for a settlement payment if they are a patient whom Las Cruces Medical Center and/or Faber & Brand filed a collections action against after Dec. 28, 2022. Collections actions include lawsuits or wage garnishments for allegedly unpaid medical debt.
How much is the debt collection settlement payment?
- All eligible class members will receive a payment of $625.
- There is also $200,000 refund pool that will be distributed among class members who previously paid Las Cruces Medical Center as a result of collections actions. The amount each member receives from the pool depends on how much they paid and the total number of class members who qualify for a refund.
No claim form required
Class members do not need to file a claim to receive compensation. The settlement administrator already has the information needed to process payments.
Class members whose contact information has changed can update it online to ensure they receive payment. This requires the Notice ID and PIN included on the mailed settlement notice.

The settlement fund of $399,375 covers:
- Settlement administration costs: $20,000
- Attorneys’ fees and costs: $131,362.99
- Service award to class representative: Up to $10,000
- Payments to class members: $625 for each eligible class member
- Refund pool: $200,000 to be distributed among class members who paid Las Cruces Medical Center

When is the debt collection settlement payout date?
Payments will be distributed no later than 44 days after the court grants final approval of the settlement.
Why is there a class action settlement?
In a class action lawsuit, the plaintiff alleged Las Cruces Medical Center and Faber & Brand violated the law by filing collections actions, including lawsuits and wage garnishments, against patients for unpaid medical debt. The parties agreed to settle the lawsuit to resolve these claims.
The defendants have not admitted any wrongdoing but agreed to the settlement, which includes changing their policies to include a requirement to determine whether patients are low-income before pursuing collections actions.
