United States residents who received written notification from Kisco Senior Living LLC about a June 2023 data incident may be eligible to claim a cash payment and credit monitoring from a class action settlement.
Kisco Senior Living agreed to pay $1.8 million to settle a class action lawsuit alleging it failed to adequately protect personal information, including names and Social Security numbers, during a data breach that occurred between June 1, 2023, and June 6, 2023. Other affected information included addresses, driver's license numbers, passport and state ID card numbers and medical and health insurance information.
Who can file a claim?
Class members are all U.S. residents who received written notification containing a unique CPT ID from Kisco Senior Living regarding the June 2023 data incident.
How much are settlement payments?
The settlement provides several types of compensation, depending on class members' eligibility and circumstances:
- Ordinary out-of-pocket losses: Up to $1,000 per person for unreimbursed costs, such as identity theft protection, professional services or other expenses incurred in response to the data incident
- Extraordinary losses: Up to $10,000 per person for documented, unreimbursed monetary losses resulting from identity theft, fraud, falsified tax returns or other misuse of personal information not already covered by ordinary out-of-pocket losses
- Attested time: Up to five hours at $30 per hour (minimum of one hour) for time spent remedying issues related to the data incident. This amount is included in the $10,000 cap for extraordinary losses.
- Credit monitoring: Three years of three-bureau coverage for all class members who request it
- California statutory payment: $250 statutory payment for class members who were California residents at the time of the incident, regardless of whether they experienced monetary loss
- Residual cash payment: If funds remain after the settlement administrator pays all other claims, it will distribute the remainder to all class members who submitted approved claims.
If the total amount of approved claims for ordinary out-of-pocket losses, extraordinary losses (including attested time) and California statutory payments exceeds the remaining settlement fund after the settlement administrator pays credit monitoring costs, administration costs, attorneys’ fees and service awards, it will reduce payments proportionally.

Why did this class action settlement happen?
The class action lawsuit claimed unauthorized individuals potentially accessed or acquired personal information, including names and Social Security numbers, during a data incident in June 2023. The plaintiffs alleged Kisco Senior Living failed to protect this information, asserting claims such as negligence and violations of the California Consumer Privacy Act.
Kisco Senior Living denied all allegations but agreed to settle to avoid further litigation costs and risks.
