
Individuals who lived in the United States and received a notice stating the December 2024 Kelly Benefits data breach exposed their private information may be eligible to claim a cash payment and credit monitoring from a class action settlement. The data breach affected approximately 533,660 people.
Kelly & Associates Insurance Group Inc. d/b/a/ Kelly Benefits agreed to pay $5 million to settle a lawsuit alleging negligence, breach of contract and unjust enrichment following a data breach that occurred between Dec. 12, 2024, and Dec. 17, 2024, exposing sensitive personal information. The cyber incident potentially affected names, Social Security numbers, tax ID numbers, medical and health insurance information, financial account information and other sensitive identifying data.
Who can file a claim for a data breach payout?
The settlement class includes all individuals who lived in the United States at the time of the Dec. 12-17, 2024, data breach and whose private information the cyber incident compromised. Anyone who received a notice about this settlement is likely a class member.
How much are settlement payments?
Class members may be eligible for several types of compensation, depending on their circumstances and the documentation they provide.
- Documented monetary losses: Class members can claim up to $5,000 per person for documented out-of-pocket losses related to the data breach. This includes unreimbursed losses from fraud or identity theft, credit monitoring costs, bank fees, long-distance phone charges, postage or mileage for local travel.
- Pro rata cash payment: All class members can also submit a claim to receive a pro rata payment estimated at $50. The final amount may be higher or lower depending on the number of valid claims submitted.
- Credit monitoring: All class members can claim three years of single-bureau credit monitoring, including dark web monitoring, identity theft insurance coverage up to $1 million and fully managed identity recovery services.
- California statutory payment: Class members with a California address on Dec. 12, 2024, can claim an estimated $100 cash payment. The final amount may be higher or lower depending on the number of valid claims submitted.
How to claim a class action payment
To receive a payment or credit monitoring, class members must submit an online claim form or print and complete the PDF claim form and mail it to the settlement administrator.

Required proof/documentation
- Documented monetary losses: Claimants must provide documentation, such as credit card statements, bank statements, invoices, phone records, screenshots or receipts, to support their claim. Personal certification is not sufficient on its own, but class members may use it to supplement documentation.
- Pro rata cash payment, credit monitoring and California statutory payment: These options do not require documentation, but claimants must attest to their eligibility and, for the California payment, confirm their address as of Dec. 12, 2024.
- Online claim form: Class members using the online claim form must provide the class member ID they received in their settlement notice.

- Class members who submit claims online may select electronic payment
- Class members who submit claims by mail receive a physical check.
- The settlement administrator will provide an activation code for credit monitoring benefits after final settlement approval.

When is the Kelly Benefits data breach settlement payout date?
The settlement administrator will issue payments and benefits to eligible class members after the court resolves any appeals and grants final approval of the settlement.
Why is there a class action settlement?
Cybercriminals allegedly gained unauthorized access to Kelly Benefits' computer systems between Dec. 12, 2024, and Dec. 17, 2024, compromising sensitive personal information. The plaintiffs alleged negligence, breach of contract and unjust enrichment.
Kelly Benefits denied any wrongdoing but agreed to settle to avoid the costs and risks of litigation.
