Patients and current and former employees of American Renal Management LLC d/b/a Innovative Renal Care who received notice that a 2024 data breach exposed their private information may be eligible to claim a cash payment from a class action settlement.

American Renal Management agreed to pay $900,000 to settle a class action lawsuit alleging negligence, breach of implied contract, unjust enrichment and violations of various consumer protection statutes related to a data breach that exposed sensitive personal information. The impacted information included names, addresses, birth dates, Social Security numbers, driver's license numbers, and financial and medical records.

Who can file a claim for a data breach payout?

Class members are individuals whose private information the February 2024 American Renal Management data breach impacted, including those who received notice of the incident.

How much are the settlement payments?

Settlement class members can claim any or all of the following benefits:

  • Documented monetary losses: Up to $5,000 per person for documented out-of-pocket monetary losses related to the data breach. This includes but is not limited to:
    • Out-of-pocket credit monitoring costs incurred on or after Feb. 14, 2025, through Dec. 21, 2026
    • Unreimbursed losses from actual fraud or identity theft
    • Unreimbursed bank fees, long-distance phone charges, postage or mileage at the prevailing IRS business use mileage rate for local travel
    • Any other documented, unreimbursed out-of-pocket losses reasonably related to the data breach or efforts to mitigate its effects
  • Pro rata cash payment: An estimated $100 per person subject to adjustment depending on the number of valid claims submitted. The actual amount may be higher or lower depending on how many people file claims and the total amount remaining in the settlement fund after the settlement administrator pays other expenses and claims.
  • Credit monitoring: Two years of one-bureau credit monitoring services, which include dark web monitoring, identity theft insurance coverage up to $1,000,000 and fully managed identity recovery services.

How to claim a settlement payment

To receive a cash payment or credit monitoring, class members must submit an online claim form or print and complete the PDF claim form and mail it to the settlement administrator.

Required proof/documentation

  • Documented monetary losses: Class members must provide third-party documentation, such as receipts, statements or letters from financial institutions to support their claim.
  • Pro rata cash payment: No documentation is required. Class members only need to attest that they are eligible.
  • Credit monitoring: No documentation is required. Class members only need to request this benefit on the claim form.
  • Online claim form: Class members using the online claim form must provide the login ID and PIN they received in their notice.

  • Class members who file a claim online may select electronic payment.
  • Class members who file a claim by mail will receive their payment by check to the address they provide on the claim form.
  • The settlement administrator will provide an enrollment code and instructions for credit monitoring to eligible class members.
