Who can file a claim?

The class includes all living persons residing in the United States who received notice from Zoll Medical Corp. that the January 2023 data incident impacted their personal information. This includes both current and former patients, as well as some current and former employees.

The settlement divides the class into two subclasses:

SSN subclass: Individuals whose Social Security numbers the data incident potentially impacted as indicated in the notice the class member received
Non-SSN subclass: Individuals whose Social Security numbers the data incident did not impact as indicated in the notice the class member received

How much can class members receive?

Class members may be eligible for two types of compensation:

Reimbursement for documented out-of-pocket losses: Class members may submit a claim of up to $5,000 to cover expenses related to the data breach, such as identity theft or fraud, credit freezes, credit monitoring, postage, mileage, copying, notary fees and other reasonable costs.
Pro rata cash payment: The pro rata cash payment is estimated at $100 for SSN subclass members and $50 for non-SSN subclass members. These amounts are subject to change based on the number of valid claims submitted and the net settlement fund after deductions for fees and expenses. Each SSN subclass claim counts as two shares. Each non-SSN subclass claim counts as one share.

How to claim a settlement payout

Class members can file a claim online or download and print a PDF claim form to complete and mail to the settlement administrator. Class members may also request a claim form by mail or email.

What proof or documentation is necessary to submit a claim?

Claimants seeking reimbursement for documented out-of-pocket losses must provide supporting documentation, such as receipts or account statements, along with a signed statement confirming the expenses resulted from the data breach. Self-created documents, such as handwritten receipts, are not enough on their own to support a claim.

For pro rata cash payments claims, class members need only select the appropriate option.

$3.5 million settlement fund breakdown

The $3,500,000 settlement fund will cover:

When is the Zoll Medical Corp. data breach settlement payout date?

The settlement administrator will issue payments approximately 60 days after the court resolves any appeals and grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit claimed Zoll Medical Corp. experienced a data breach in January 2023 that may have exposed the personal information of patients and employees. The plaintiffs alleged that the company failed to adequately protect sensitive data, including Social Security numbers and other personal details.

Zoll Medical Corp. denies any wrongdoing but agreed to settle to avoid the costs and risks of litigation and to provide compensation to those affected.
