
Consumers who purchased, paid for or provided reimbursement for certain generic prescription drugs between May 1, 2009, and Dec. 31, 2019, may be eligible to claim a cash payment from a class action settlement.
Sun Pharmaceutical Industries Inc. and Taro Pharmaceuticals USA Inc. agreed to pay $200 million to settle a class action lawsuit. The lawsuit alleged they violated federal and state antitrust laws, consumer protection statutes and common law by engaging in conduct that harmed competition and caused end payers to overpay for certain generic drugs.
Who can file a claim?
Class members must meet all of the following criteria:
- They indirectly purchased, paid for and/or provided reimbursement for some or all of the purchase price for any of the named generic drugs (pages 19-28 of the settlement agreement) between May 1, 2009, and Dec. 31, 2019.
- They purchased the drugs in any of the 50 United States (except Indiana and Ohio), the District of Columbia, Puerto Rico or the U.S. Virgin Islands.
- They did not purchase the drugs for resale or directly from any of the defendants.
There are two main groups of class members:
- Consumers: Individuals who purchased one or more of the named generic drugs in a pharmacy or by mail-order prescription for personal use
- Third-party payers: Entities that paid for and/or reimbursed some or all of the purchase price of one or more of the named generic drugs for use by their members, employees, insureds, participants or beneficiaries
Class members who made both eligible and ineligible purchases are included in the class only for the eligible purchases.
Who is excluded from the class?
- All federal governmental entities
- All state governmental entities (except for cities, towns, municipalities, counties and other local governmental entities with self-funded prescription drug plans)
- All governmental Medicaid agencies, private Medicaid managed care organizations and consumers whom Medicaid covered for their purchases of named generic drugs
- Fully insured employers using fully insured plans (i.e., employers that purchased insurance covering 100% of their reimbursement obligation to members)
- Pharmacy benefit managers
How much can class members get?
The total settlement fund is $200 million. The settlement administrator will deduct administrative costs, attorneys’ fees and litigation expenses, and service awards to class representative before distributing the fund to class members.
The settlement administrator will determine the amount each class member can receive on a pro rata basis, meaning each class member's payment will be proportional to the amount they spent on the named generic drugs during the class period compared to the amount all class members paid.

Class members can submit the online claim form or download and print a PDF claim form to fill out and mail to the settlement administrator.

What proof or documentation is necessary to file a claim?
Class members must provide documentation showing they purchased at least one of the named generic drugs during the class period. Acceptable proof includes:
- Receipts or invoices identifying the drug purchased
- Account statements from a pharmacy
- Itemized records of purchases from a pharmacy
- Other records showing the drug purchased and the amount paid between May 1, 2009, and Dec. 31, 2019
Third-party payers may need to provide additional data, such as National Drug Code numbers, fill dates and amounts paid.

$200 million settlement fund
The $200,000,000 settlement fund will cover:
- Settlement administration costs: Up to $750,000
- Attorneys' fees: Up to $666,666.67
- Attorneys' expenses: Up to $4,000,000 for past and future expenses
- Service awards to class representatives: Up to $500,000 total
- Payments to eligible class members: The remainder of the fund

Why is there a class action settlement?
The class action lawsuit alleged Sun Pharmaceutical Industries Inc. and Taro Pharmaceuticals USA Inc. engaged in unlawful conduct, such as price fixing, bid rigging and market allocation, for certain generic drugs. The plaintiffs claimed this violated federal and state antitrust laws and consumer protection statutes, resulting in higher prices for consumers and third-party payers.
Sun and Taro deny any wrongdoing but agreed to settle to avoid the costs and uncertainties of further litigation.
