Who can file a claim?

Class members include individuals residing in the United States whose personal information the October 2024 Furman Foods data breach incident potentially compromised.

How much can class members receive?

The settlement provides several forms of compensation, depending on qualifying class members' circumstances and losses.

Option 1: Reimbursement for losses

Out-of-pocket expenses: Up to $300 for documented expenses directly related to the data incident, such as credit monitoring fees, costs to replace IDs or postage to contact banks. These expenses must have occurred between Oct. 10, 2024, and Sept. 30, 2026.

Lost time: Up to five hours at $20 per hour ($100 maximum) for time spent responding to the incident, such as changing passwords and monitoring accounts. This lost time payment is included in the $300 cap for out-of-pocket expenses.

Losses due to identity theft or fraud: Up to $2,000 for documented, unreimbursed monetary losses the data incident most likely caused that other categories don't already cover. These losses must have occurred between Oct. 10, 2024, and Sept. 30, 2026.

Option 2: Alternative payment

A one-time $35 payment in lieu of losses or lost time. This option is for class members who do not wish to submit documentation or who did not incur qualifying expenses.

Option 3: Credit monitoring: All class members are eligible for two years of credit monitoring services, including $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning and public records monitoring.

How to claim a settlement payment

To receive a settlement payout, class members can file a claim online. There is no PDF claim form on the settlement website.

What proof and documentation is required to file a claim?

To file an out-of-pocket expenses or losses for identity theft or fraud claim, class members must provide documentation, such as receipts, to show how much they spent or lost. They may also submit self-generated notes to explain or support their proof, but those notes are not sufficient proof on their own.
To file a lost time claim, class members must provide a short description of the activities they performed.
To file an alternative payment or credit monitoring claim, class members need only select the appropriate option on the claim form.
To file an online claim, class members must provide their last name and the notice ID from the settlement notice they received.

Payout options

The settlement administrator will issue payments for approved claimants by check or electronic payment. It will provide credit monitoring enrollment instructions to eligible claimants.

The settlement fund will include:

Service award to class representative: $5,000
Payments to approved claimants: Amount depends on the number and type of claims submitted

When is the Furman Foods data settlement payout date?

The settlement administrator will distribute payments to approved claimants after the court resolves any appeals and grants final approval of the settlement.

Why did this class action settlement happen?

The lawsuit alleges Furman Foods failed to adequately protect personal information during a cyberattack in October 2024, resulting in unauthorized access to files containing sensitive data.

Furman Foods denies any wrongdoing but agreed to settle to avoid the expense, risks and disruptions of litigation.
