Why is there a class action settlement?
This class action lawsuit alleged FRL Automotive LLC, doing business as Toyota of North Miami, allegedly sent marketing text messages to individuals after they requested to stop receiving such messages. The class action claimed these actions violated the TCPA and FTSA, which restrict companies from sending marketing texts after a consumer opts out.
FRL Automotive denies the allegations but agreed to settle to avoid the expense and risk of continued litigation and a trial.
