Individuals who received a notice stating the April 2023 Fincantieri Marine Group LLC data breach may have impacted their private information could be eligible to submit a claim for up to $5,000 and other benefits from a class action settlement.

Fincantieri Marine Group LLC agreed to pay $515,000 to settle a class action lawsuit alleging it failed to adequately protect private information, resulting in unauthorized access to files containing sensitive personal information.

Who can file a claim?

Class members are individuals who received a notice from Fincantieri Marine Group stating a data breach discovered on or about April 6, 2023, may have compromised their private information.

How much can class members get?

Class members have the following options:

  • Reimbursement for documented out-of-pocket losses: Class members may claim up to $5,000 for actual, documented out-of-pocket losses that are fairly traceable to the data breach. Claimants must provide reasonable third-party documentation of actual, unreimbursed losses. Self-prepared documents alone are not sufficient.
  • Pro rata cash payment: Class members may also submit a claim to receive a cash payment from the settlement fund. The payment is expected to be approximately $100. The settlement administrator will determine the final payment amount based on the number of valid claims filed and the funds remaining after settlement expenses.
  • Credit monitoring services: All class members may elect to receive three years of one-bureau credit monitoring services.

If valid claims exceed available funds, the settlement administrator will reduce cash payments on a pro rata basis.
