Nationstar $1.5M Mortgage Fees Class Action Settlement

Current and former homeowners who had a mortgage serviced by Nationstar Mortgage in Florida and whom the company charged specific fees related to service of process, property maintenance or property inspection may be eligible to claim up to $300 from a class action settlement.

Nationstar Mortgage LLC, d/b/a Mr. Cooper, agreed to pay $1.5 million to settle a class action lawsuit. The plaintiff alleged Nationstar charged improper fees to Florida mortgage borrowers, including fees for service of process on unknown parties, property maintenance fees that were actually property registration fees, and property inspection fees when no inspection occurred.

Who can file a claim for a mortgage fee settlement payout?

Class members must meet the following criteria:

  • They had or have a mortgage contract serviced by Nationstar Mortgage, d/b/a Mr. Cooper, for a property located in Florida.
  • Nationstar serviced their mortgage on behalf of U.S. Bank or another note or mortgage holder between May 29, 2013, and the date of the final approval order of this settlement.
  • Nationstar charged them at least one of the following fees:
    • A fee for service of process on an unknown spouse or unknown tenant, including references such as John Doe or Jane Doe
    • A property maintenance fee that was actually a fee to register the property with a government unit or subunit
    • A property inspection fee when the inspector did not have access to the property

How much are settlement payments?

Pro rata cash payment: Class members can submit a claim to receive a pro rata cash payment of up to $100 per qualifying fee paid up to a maximum of $300. The settlement administrator will determine the final payment amount by the number of fees paid and total number of claims filed.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

The claim deadline is Aug. 15, 2026.

Settlement fund breakdown

The settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys' fees: Up to $1,300,000
  • Attorneys' expenses: Up to $60,000
  • Service award to class representative: $10,000
  • Payments to claimants: Up to $1,500,000

When is the Nationstar mortgage fees settlement payout date?

The settlement administrator will issue payments to approved claimants approximately 90 days after the court grants final approval of the settlement.

Why is there a class action settlement?

The class action lawsuit alleged Nationstar Mortgage LLC charged improper fees on mortgage accounts, including fees for service of process on unknown parties, property maintenance fees that were actually for property registration, and property inspection fees when no inspection occurred. The claims were based on alleged violations of the Florida Consumer Collection Practices Act, the Florida Deceptive and Unfair Trade Practices Act and breach of contract.

Nationstar denies the allegations but agreed to settle to avoid the expense and risk of continued litigation and a possible trial.
