Individuals who received a notice stating a 2022 data breach involving Falcon Healthcare Inc., d/b/a Interim Healthcare, impacted their personal information may be eligible to claim up to $5,000 from a class action settlement.

Falcon Healthcare Inc. agreed to pay $800,000 to resolve a class action lawsuit alleging it failed to implement reasonable security measures, resulting in unauthorized access to sensitive personal information between April 29, 2022, and July 3, 2022.

Who can file a claim?

Class members must meet the following criteria:

  • They are a living individual residing in the United States.
  • They received a notice from Falcon Healthcare stating the data incident that occurred between April 29, 2022, and July 3, 2022, may have impacted their personal information.

How much can class members get?

  • Cash Payment A – Documented losses: Up to $5,000 for documented, unreimbursed monetary losses related to the data incident. To qualify, class members must provide supporting documentation showing the actual loss and that it is fairly traceable to the data incident.
  • Cash Payment B – Alternative cash payment: An estimated flat cash payment of $100. The final amount will depend on the total number of valid claims, and the settlement administrator may adjust it up to a maximum of $250 per person or reduce it if claims exceed the available funds.
  • Medical data monitoring: Two years of CyEx Medical Shield, which includes medical identity monitoring, real-time alerts and up to $1,000,000 in insurance coverage for medical identity theft. Class members can claim this benefit in addition to either cash payment.

The settlement administrator will distribute the fund in the following order: service awards to class representatives, attorneys’ fees and costs, medical data monitoring and then cash payments to class members.

If the number of valid claims exceed the available funds, the settlement administrator will reduce all cash payments.

How to claim a data breach payment

Class members can submit the online claim form or download, print and complete the PDF claim form and mail it to the settlement administrator. The claim deadline is Jan. 26, 2026.

Required information

  • For online claims, claimants must provide the notice ID and confirmation code from the personalized notice they received via mail or email.
  • For Cash Payment A – Documented losses, claimants must provide reasonable documentation of actual, unreimbursed losses that are fairly traceable to the data incident. Examples include receipts, correspondence or other records. Self-prepared documents, such as handwritten receipts, are not sufficient on their own.
  • For Cash Payment B – Alternative cash payment and medical data monitoring, claimants do not need to submit documentation. They simply need to select the the appropriate option on the claim form.

When is the Falcon Healthcare settlement payout date?

The settlement administrator will distribute settlement payments and benefits approximately 60-90 days after the court resolves any appeals and grants final approval of the settlement. 

Why did this class action settlement happen?

The class action lawsuit alleged Falcon Healthcare experienced a cybersecurity incident in 2022 during which unauthorized parties accessed and downloaded patient information. The plaintiffs claimed that Falcon Healthcare failed to implement adequate data security measures, resulting in the exposure of sensitive personal and medical information.

Falcon Healthcare denies any wrongdoing or liability but agreed to settle the lawsuit to avoid the costs and uncertainties of litigation.
