Current or former employees of Excel Fitness Management LLC residing in the United States whose personal information may have been exposed in the January 2025 data breach may be eligible to claim up to $4,075 and/or credit monitoring from a class action settlement.

Excel Fitness Consolidator LLC, d/b/a Excel Fitness Management LLC, agreed to resolve a class action lawsuit alleging a targeted cyberattack in January 2025 compromised files containing sensitive employee information, including names, addresses, Social Security numbers, dates of birth, financial account details and other personal data.

Who can file a claim?

The class includes all current and former employees of Excel Fitness Management LLC who reside in the United States and whose personal information the data breach the company discovered in January 2025 potentially exposed, including anyone who received notice of the data incident.

How much can class members receive?

All class members are eligible for:

  • Credit monitoring services: Two years of CyEx Financial Shield Complete, which includes $1 million in identity theft insurance and access to fraud resolution agents

Class members who experienced losses due to the data breach can claim:

  • Out-of-pocket and extraordinary losses: Up to $4,000 in reimbursement for documented losses incurred between Jan. 17, 2025, and Sept. 21, 2026. Eligible expenses include:
    • Losses resulting from identity theft or fraud
    • Fees for credit reports, credit monitoring or freezing/unfreezing credit
    • Costs to replace IDs
    • Postage to contact banks by mail
  • Lost time: Up to three hours at $25 per hour (maximum $75) for time spent responding to the data incident, such as changing passwords, investigating suspicious activity or researching the breach. Class members must attest that the lost time is related to the data incident.

Alternatively, class members may choose:

  • Alternative cash payment: A one-time payment, expected to be $50, instead of claiming out-of-pocket losses or lost time. The actual amount may be higher or lower depending on the total number of claims filed.

There is a cap of $175,000 on the total amount paid to class members. If the total value of all claims exceeds this amount, the settlement administrator will reduce individual payments proportionally so the total does not exceed $175,000.

How to claim an award

Class members can file a claim online or download and print a PDF claim form and mail or email it to the settlement administrator.

Is proof or documentation required to submit a claim?

Yes.

  • For out-of-pocket and extraordinary losses, class members must provide documentation, such as bank statements, receipts or other evidence showing the amount spent or lost due to the data breach. They may include self-prepared notes or explanations to support their claim, but these are not sufficient on their own.
  • For lost time and alternative cash payment claims, class members must select the appropriate option on the claim form.

$175,000 settlement fund

The $175,000 settlement fund will cover:

  • Settlement administration costs: To be determined
  • Attorneys' fees and costs: $150,000
  • Service awards to class representatives: $3,000 each (total $6,000)
  • Payments to eligible class members: Up to $175,000

  • Final approval hearing: Feb. 4, 2027

When is the Excel Fitness data breach settlement payout date?

The settlement administrator will distribute payments after the court resolves any appeals and grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit claimed a targeted cyberattack on Excel Fitness Management LLC’s computer systems in January 2025 exposed files containing employees’ personal information, including names, addresses, Social Security numbers, dates of birth and financial account details. The plaintiffs alleged Excel Fitness did not adequately protect their data.

The company denies any wrongdoing but agreed to settle to avoid the costs and risks of continued litigation and provide compensation to those affected.
