Equinox Inc. agreed to pay $685,000 to resolve a class action lawsuit alleging it failed to protect private information, leading to a data incident on or about April 29, 2024.
Who can file a claim?
The settlement class includes all living individuals residing in the United States whom Equinox sent a notice stating the April 29, 2024 data incident may have impacted their private information.
The compromised information may include:
- Names
- Addresses
- Dates of birth
- Social Security numbers
- Driver’s license numbers
- Health insurance information
- Medical treatment or diagnosis information
- Medication information
- Financial information
- Provider names
- Medical record numbers or patient IDs
How much can class members receive?
- Documented monetary losses: Class members may claim up to $5,000 for out-of-pocket expenses directly related to the data incident. Examples include:
- Unreimbursed losses from fraud or identity theft
- Out-of-pocket credit monitoring costs incurred on or after April 29, 2024, through Oct. 23, 2026
- Unreimbursed bank fees, long-distance phone charges, postage or mileage for local travel at the prevailing IRS business use mileage rate
- Any other documented, unreimbursed out-of-pocket losses reasonably related to the data incident or efforts to mitigate its effects
- Pro rata cash payment: Class members who do not have documented monetary losses may claim a pro rata cash payment estimated at $100. The settlement administrator will determine the actual amount by dividing the settlement funds (after deducting administration costs, attorneys’ fees, service awards and payments for documented losses and credit monitoring) by the number of valid claims.
- Credit monitoring: All class members may claim three years of credit monitoring services, which include:
- One-bureau credit monitoring
- Dark web monitoring
- Identity theft insurance coverage up to $1,000,000
- Fully managed identity recovery services
How to claim a class action payment
Class members can complete the online claim form or download, print, complete and mail the PDF claim form to the settlement administrator.

What proof or documentation is necessary to submit a claim?
- All claimants must provide the notice ID from the settlement notice they received. Online claimants must also provide the confirmation code from the same notice.
- For documented monetary losses, claimants must provide receipts, statements or other proof of out-of-pocket expenses, such as credit monitoring invoices, bank statements or fraud-related correspondence.
- For pro rata cash payments and credit monitoring, claimants must attest to their eligibility and select the appropriate option on the claim form.

$685,000 settlement fund breakdown
The $685,000 settlement fund will cover:

- Attorneys' fees: Up to $228,333.33
- Attorneys' expenses: To be determined
- Service awards to class representatives: Up to $2,500 each ($5,000 total)
- Credit monitoring services: Cost determined by number of valid claims for this option
- Payments to eligible class members: Remainder of the fund
If the total value of valid claims exceeds the available funds, the settlement administrator may reduce payments on a pro rata basis.
