BrandSafway $612,500 Washington Job Posting Settlement

Job seekers who applied for a position in Washington state with BrandSafway Services LLC or its related companies between Jan. 1, 2023, and July 8, 2026, in which the job posting did not include wage or benefits information may be eligible to claim a cash payment up to $5,000 from a class action settlement.

BrandSafway Services LLC agreed to pay $419,882.36 to $612,500 to resolve a class action lawsuit alleging it failed to disclose wage and benefits information in job postings as required by Washington law.

Who can file a claim?

Class members must meet all of the following criteria:

  • They applied for a job opening in the state of Washington with any of the following companies between Jan. 1, 2023, and July 8, 2026:
    • BrandSafway Services LLC
    • BrandSafway LLC
    • BrandSafway Industries LLC
    • BrandSafway Access Solutions LLC
    • BrandSafway LDAR LLC
    • Safway Atlantic LLC
    • Safway Group Holding LLC
    • Aluma Systems Concrete Construction LLC
    • Brand Shared Services LLC
    • Brand Industrial Projects LLC
    • SafeWorks LLC
  • The job posting for the position did not disclose a wage scale or salary range and/or a general description of benefits and other compensation to be offered to the hired applicant.

BrandSafway’s records identified approximately 245 class members.

How much can class members get?

Eligible class members who submit a valid claim form will receive an equal share of the net settlement fund up to $5,000.

The settlement fund is structured as follows:

  • Minimum fund: $419,882.36 (if class members submit 123 or fewer valid claims)
  • Maximum fund: $612,500 (if all 245 class members submit valid claims)

The settlement administrator will report payments as nonwage damages (1099 income).

How to claim a class action payment

Class members can submit the online claim form or download and print the PDF claim form (Page 28 of the settlement agreement), complete it and mail or email it to the settlement administrator.

Required information

To file an online claim, class members must provide the unique ID and PIN from the settlement notice they received.

Payout options

The settlement administrator will mail checks to the address class members provide on their claim form. Class members must cash their checks within 180 days of issuance. After this time, the administrator will send uncashed checks to the state of Washington as unclaimed property.

Settlement fund breakdown

The settlement fund of $419,882.36 to $612,500 will cover:

  • Settlement administration costs: Up to $20,000
  • Attorneys’ fees: $180,688
  • Attorneys’ expenses: Up to $5,000
  • Service award to class representative: $20,000
  • Payments to eligible class members: Remaining funds

When is the Hill v. BrandSafway Services LLC, et al. payout date?

The settlement administrator will mail payments approximately 28 days after the court resolves any appeals and grants final approval to the settlement.

Why did this class action settlement happen?

The lawsuit alleged BrandSafway Services LLC and related companies violated Washington law by not including wage and benefits information in job postings for open positions.

The defendants denied all allegations but agreed to settle to avoid the uncertainty, risks and expense of ongoing litigation.
