Washington job seekers who applied for a position with JBS USA Sanitation Corp. or Empire Packing Co. L.P. between Jan. 1, 2023, and Aug. 26, 2025, and the job posting did not include a wage scale or salary range may be eligible to claim a cash payment from a class action settlement.

JBS USA Sanitation Corp. and Empire Packing Co. L.P. agreed to pay between $1.4 million and $2.13 million to resolve a class action lawsuit alleging they posted job openings in Washington without including the required wage or salary information in violation of state law.

Who can file a claim?

Individuals must meet all of the following criteria:

  • They applied for a job opening in the state of Washington with JBS USA Sanitation Corp. or Empire Packing Co. L.P.
  • They submitted their application between Jan. 1, 2023, and Aug. 26, 2025.
  • The job posting did not disclose a wage scale or salary range for the position.

The settlement administrator will use the defendants’ records to identify eligible class members.

How much can class members get?

Each eligible class member who submits a valid and timely claim form will receive an equal share of the settlement fund after deductions for attorneys’ fees, service awards and administrative costs. The payment will be treated as non-wage damages and reported on a 1099 form.

The total settlement fund ranges from $1,399,242.75 to $2,126,250, depending on the number of valid claims submitted. If 50% or fewer class members (about 532 people) participate, the defendants will pay the minimum settlement fund of $1,399,242.7. For each additional participant beyond 532, the defendants will increase the fund by $1,366.55 per person up to the maximum settlement fund of $2,126,250.

How to claim a settlement payment

Class members can file a claim online using the online claim form or download, print and complete the PDF claim form (Page 29 of the settlement agreement) and mail or email it to the settlement administrator. The claim deadline is Nov. 22, 2025.

Required information

To file an online claim, class members must provide the unique ID and PIN printed on the settlement notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator at info@EmpireEPOASettlement.com or 844-496-1151 and provide their full name and mailing address.

Payout options

  • The settlement administrator will mail payments paper checks to the address provided on the claim form.
  • Recipients must cash their checks within 120 days of issuance.

The settlement fund of $1,399,242.75 to $2,126,250 covers:

  • Administrative costs: Up to $20,000
  • Attorneys’ fees and expenses: $615,840
  • Service award to class representative: $25,000
  • Payments to eligible class members: Remaining funds

When is the Nugent v. JBS USA Sanitation Corp. payout date?

The settlement administrator will mail payments to eligible class members approximately 60 days after it resolves appeals and the court grants final approval of the settlement.

Why is there a class action settlement?

The class action lawsuit alleged that JBS USA Sanitation Corp. and Empire Packing Co. L.P. failed to disclose wage scales or salary ranges in job postings as required by Washington law.
