
Individuals whom Eureka Casino Hotel notified of a data breach that compromised their personal information may be eligible to claim up to $5,000 and other benefits from a class action settlement.
Rancho Mesquite Casino Inc., dba Eureka Casino Hotel, agreed to pay $1 million to settle a class action lawsuit alleging it failed to adequately protect customer data during a security incident that occurred between Nov. 9 and Nov. 13, 2022. The lawsuit claimed the breach exposed sensitive personal information, including names, Social Security numbers, financial account details, passport numbers and driver’s license or state-issued identification numbers.
Who can file a claim?
Class members must meet the following criteria:
- They are an individual residing in the United States.
- The Eureka Casino Hotel data security incident that occurred between Nov. 9 and Nov. 13, 2022, compromised their private information.
- They received a notice from Eureka Casino Hotel about the data breach.
The compromised data potentially includes:
- Full names
- Social Security numbers
- Financial account numbers
- Passport numbers
- Driver’s license or state-issued identification numbers
How much can class members get?
The settlement provides several forms of compensation, depending on the class member's circumstances and losses:
- Out-of-pocket expense reimbursement: All class members who suffered a proven monetary loss as a result of the data breach and submit a valid claim can receive up to $5,000 in reimbursement. Eligible expenses include unreimbursed losses related to fraud or identity theft and costs for credit monitoring, postage, copying, travel, notary charges, phone/data charges, bank fees, accountant or attorney fees and other expenses directly related to the data incident. The settlement administrator may reduce payments on a pro rata basis if the total approved claims exceed the available settlement funds.
- California statutory cash payment: Class members who are California residents or resided in California at any time between Nov. 9, 2022 and May 11, 2026, can claim an additional $100 statutory payment. The settlement administrator may reduce payments on a pro rata basis if total claims exceed the settlement fund.
- Pro rata cash payment: The settlement administrator will distribute any remaining funds after all other payments equally among all class members who submit a valid claim and request this benefit.

What proof or documentation is necessary to submit a claim?
- To file an online claim, class members must provide the notice ID and confirmation code from the personalized notice they received in the mail or via email.
- To file a claim by mail, class members must provide either the notice ID or their Social Security number.
- To file an out-of-pocket expense claim, class members must provide documentation, such as receipts, bills or other third-party records, showing the data breach most likely caused the loss.
- To file a California statutory payment claim, class members must provide a sworn attestation of residency.
- To file a pro rata cash payment claim, class members need only select the appropriate option.

When is the Eureka Casino data breach settlement payout date?
