E-Benefit Solution Inc. agreed to settle a class action lawsuit related to a targeted cyberattack in December 2024. The plaintiff claimed unauthorized third parties accessed files containing personal information, including names and Social Security numbers.

Who can file a claim for a data breach payout?

Class members must meet the following criteria:

  • The December 2024 data incident involving E-Benefit Solution compromised their private information.
  • They reside in the United States and received written or substitute notification from E-Benefit Solution Inc. about the data incident.

How much are settlement payments?

Class members have the following benefit options:

  • Credit monitoring: All class members can elect to receive two years of CyEx Financial Shield Total. Services include monitoring for identity theft, unauthorized financial transactions and high-risk activities, $1 million in financial fraud insurance and access to to fraud resolution agents.
  • Cash payment A – Documented losses: Class members can claim up $5,000 in out-of-pocket losses that occurred between Dec. 10, 2024, and July 1, 2026, and are traceable to the data breach. This includes monetary losses from identity theft or fraud, fees for credit reports or monitoring, costs to replace IDs and postage to contact banks.
  • Cash payment B – Alternate cash: Class members who do not submit a documented losses claim can submit to receive a one-time $40 cash payment.
    • Once total claims for this benefit option reach $100,000, the settlement administrator will not accept no further claims.

How to claim a class action rebate

To claim a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail it to the settlement administrator.
