Current and former employees residing in the United States whose private information the October 2023 Delphinus Engineering data breach may have been compromised could be eligible to submit a claim for up to $10,000 plus a cash payment and credit monitoring services from a class action settlement. The data incident compromised the personally identifiable information of approximately 3,151 individuals.

Delphinus Engineering Inc. agreed to pay $350,000 to settle a class action lawsuit alleging an unauthorized third party accessed its computer systems in October 2023. The plaintiffs claimed the cybersecurity incident compromised the PII of affected individuals, including names, Social Security numbers, dates of birth, passport numbers and other sensitive data.

Who can file a claim for a data breach payout?

Class members are current and former employees residing in the United States whose personally identifiable information the October 2023 Delphinus data breach compromised. They must also have received notice from Delphinus regarding the data incident.

How much will the settlement payment be?

Class members can submit a claim to receive one or more of the following:

  • Out-of-pocket losses: Class members can claim up to $10,000 for documented out-of-pocket losses. This can include monetary losses due to fraud or identity theft, professional attorney or accountant fees, costs to freeze/unfreeze credit, credit monitoring costs incurred after the data breach and other expenses such as notary, copying and postage.
  • Cash fund payment: All class members can also submit a claim to receive a pro rata cash payment from remaining settlement funds after the settlement administrator pays all other fees, costs and awards.
  • Credit monitoring: All class members can elect to receive three years of credit monitoring services.

To receive a settlement payment, class members can file a claim online or download and print the PDF claim form to complete and mail to the settlement administrator.

When is the Delphinus data breach settlement payout date?
