Consumers who received a notice stating their private information may have been affected by a data breach at Center for Vein Restoration Oct. 1- 6, 2024, may qualify to claim up to $5,000 from a class action settlement.

Center for Vein Restoration LLC agreed to pay $3.55 million to settle a class action lawsuit alleging it failed to adequately protect sensitive personal information. The plaintiffs claim a data breach resulted in unauthorized access to private information belonging to current and former patients and employees. The compromised data included names, addresses, Social Security numbers, dates of birth, laboratory data, financial data, employee data and business data.

Who is eligible for a Center for Vein Restoration payout?

Class members must meet all of the following criteria:

  • They are a living individual residing in the United States.
  • They received a notice from Center for Vein Restoration stating their private information may have been impacted by the data incident that occurred Oct. 1-6, 2024.

How much is the data breach payment?

Class members can claim one of two types of cash payments in addition to two years of free medical information monitoring:

  • Cash payment A – documented loss reimbursement: Up to $5,000 for documented out-of-pocket losses related to the data incident. Eligible expenses include but are not limited to:
    • Bank fees
    • Postage and mailing costs
    • Gasoline for local travel
    • Fees for credit reports, credit monitoring or identity theft insurance products
    • Professional fees to address identity theft or fraud
  • Cash payment B – alternate cash payment: Class members who do not have documented losses may claim an alternate cash payment estimated at $100. The actual amount may be adjusted based on the total number and value of valid claims submitted.
  • Medical information monitoring: All class members, regardless of which cash payment option they select, may also claim two years of free medical information monitoring.

How to claim a class action rebate

Class members can file a claim online or download and print the PDF claim form, complete it and mail it to the settlement administrator. The claim deadline is Oct. 21, 2025.

Information and documentation required

  • For cash payment A (documented losses), class members must submit reasonable documentation of their expenses, such as receipts, account statements or correspondence that shows the loss or expense was related to the data breach. Self-prepared documents, such as handwritten notes, are not sufficient on their own but may be used to clarify or support other documentation.
  • All class members must provide the unique ID from the postcard settlement notice they received.

Payout options

Eligible class members who submit a valid claim will receive an email to select their payment via:

  • Electronic payment
  • Paper check

$3.55 million data incident settlement fund breakdown

The $3,550,000 settlement fund includes:

  • Settlement administration costs: To be determined
  • Attorneys' fees: Up to $1,183,333.33
  • Attorneys' expenses: To be determined
  • Service awards to class representatives: Up to $1,500 each
  • Credit monitoring costs: To be determined
  • Payments to eligible class members: The remainder of the fund

The settlement fund will first be used to pay for the cost of medical information monitoring. The remaining funds will then be distributed to claimants for cash payments.

When is the Center for Vein Restoration data breach payout date?

Settlement payments will be distributed approximately 90 days after the court grants final approval of the settlement and any appeals are resolved.

Why was there a class action settlement?

The class action lawsuit alleged a data incident at Center for Vein Restoration in October 2024 resulted in unauthorized access to or acquisition of private information belonging to patients and employees. The plaintiffs claimed the company failed to adequately protect their private information.

Center for Vein Restoration denies any wrongdoing or liability, but both parties agreed to settle to avoid the cost, risk and time of continued litigation.
