CellNetix Labs LLC and CellNetix Pathology PLLC agreed to pay $227,500 to settle a class action lawsuit alleging an unauthorized third party accessed their systems in December 2023, potentially exposing sensitive personal information. The affected information may include:

- Passport numbers
- Health insurance policy numbers

Who can file a claim?
Class members must meet the following criteria:
- They are an individual residing in the United States.
- The December 2023 CellNetix data incident potentially impacted their private information.
- They received a formal notice of the data breach from CellNetix by mail or email.
Those who did not receive a notice but believe the breach affected their information should contact the settlement administrator for assistance. They must provide documentation showing the incident impacted them.

How much can class members receive?
There are three main categories of compensation:
- Documented out-of-pocket expenses: Class members can claim up to $5,000 for actual, documented and unreimbursed monetary losses that are fairly traceable to the data incident. Eligible expenses may include:
- Unreimbursed losses from fraud or identity theft
- Postage, copying, faxing, scanning or notary charges
- Mileage and other travel-related charges
- Unreimbursed costs of credit monitoring or identity theft monitoring purchased between June 26, 2023, and Jan. 26, 2026
- Reimbursement for lost time: Class members who submit a claim for out-of-pocket losses may also claim up to three hours of time spent responding to the incident compensated at $30 per hour (maximum $90).
- Alternative compensation: Class members who do not submit a claim for out-of-pocket expenses or lost time or whose claim the settlement administrator does not approve may elect to receive a pro rata cash payment. The amount of this payment will depend on the number of valid claims and the amount remaining in the settlement fund after the settlement administrator makes other payments.

Class members can file a claim online or download, print and complete the PDF claim form and mail it to the settlement administrator. The claim deadline is Jan. 26, 2026.

Proof or documentation required to submit a claim
- To file an online claim, class members must provide the username and password from the notice they received. Those who print the claim form only need to provide the username.
- To file an out-of-pocket expenses claim, class members must submit receipts or official records. Self-prepared documents (like handwritten receipts) alone are not sufficient, but they may supplement other documentation.
- To file a lost time claim, class members must provide an attestation describing the time spent.
- To file an alternative compensation claim, class members do not need to provide documentation.

$227,500 settlement fund breakdown
The $227,500 settlement fund covers:
- Settlement administration costs: To be determined
- Attorneys' fees and costs: Up to $75,833.33
- Attorneys' expenses: To be determined
- Service award to class representative: $2,500
- Payments to eligible class members: Remainder of the fund
If the total amount of valid claims exceeds the remaining fund, the settlement administrator will reduce payments proportionally so that the total does not exceed $227,500.

When is the CellNetix data settlement payout date?
The settlement administrator will issue checks to eligible claimants approximately 30 days after it completes claim validation or 60 days after the court resolves appeals and disputes and grants final approval of the settlement, whichever is later.
