Individuals whose vehicle the City of Calverton Park towed from private property between Sept. 25, 2018, and June 26, 2025, for an alleged violation of a municipal nuisance ordinance or who paid a special tax bill for such a tow during that period may be eligible to claim a cash payment from a class action settlement.

The City of Calverton Park agreed to pay $425,000 to settle a class action lawsuit alleging the city towed vehicles from private property without proper notice or opportunity to challenge the tow, and imposed special tax bills in violation of constitutional due process rights.

Who can file a claim?

There are two groups of eligible class members. Class members may be eligible if they fall into either or both of these categories:

  • The City of Calverton Park towed their vehicle from private property between Sept. 25, 2018, and June 26, 2025, for an alleged violation of a municipal nuisance ordinance regardless of whether they recovered their vehicle from the tow lot.
  • They paid the City of Calverton Park a special tax bill (sometimes called a nuisance abatement fee) for a vehicle towed from private property for an alleged municipal nuisance ordinance violation during the same period.

Class members who had more than one vehicle towed or paid more than one special tax bill can claim for each incident. Online claimants should submit a single claim form and list all incidents while mail-in claimants should request additional forms from the settlement administrator.

How much can class members get?

The amount each class member can receive depends on several factors:

  • Whether the claimant recovered their vehicle from the tow lot
  • The number of days the city impounded the vehicle
  • Any release, towing or storage fees the claimant paid to the city or tow lot
  • The amount of any special tax bill paid

Here’s how the settlement structures the payments:

  • Class members who recovered their vehicle: The payment is based on the number of days the city impounded the vehicle plus any release, towing or storage fees the class member paid.
  • Class members who did not recover their vehicle: May receive a set amount to compensate for the loss of their vehicle.
  • Class members who paid a special tax bill: The payment is based on the amount they paid for the special tax bill.

The settlement administrator will calculate the total payout for each claimant after it processes all valid claims. It may adjust the final amount depending on the number of valid claims and the total settlement fund available.

How to claim a class action settlement payment

Class members can file a claim online or download and print a PDF claim form to complete and mail to the settlement administrator. They may also request a claim form by calling 800-792-1466 or emailing CalvertonParkClassAction@atticusadmin.com.

Class members who had more than one vehicle towed or paid more than one special tax bill should submit only one online claim listing all incidents or request additional paper claim forms if filing by mail.

Is any proof or documentation required to submit a claim?

No. The settlement administrator may ask claimants to provide documentation showing they owned the towed vehicle or paid the special tax bill, or request additional information if their claim is incomplete or insufficient. Failure to provide requested documentation may result in claim denial.

Payout options

The settlement administrator will mail checks to the address the class member provides on the claim form.

$425,000 settlement fund breakdown

The $425,000 settlement fund covers:

  • Settlement administration costs: To be determined
  • Attorneys' fees and expenses: $154,998.36
  • Service awards: Up to $8,000 for five class representatives up to (Up to $40,000 total)
  • Payments to eligible class members: Remaining funds

  • Final approval hearing: Sept. 18, 2026

When is the Calverton Park class action settlement payout date?

If the court approves the settlement and there are no appeals, the settlement administrator says it expects to send payments approximately 70 days after the court issues the final approval order.
