Banner Health Patient Privacy Class Action Settlement

Individuals who logged in to a Banner Health patient account (previously called the MyBanner patient portal) between June 1, 2020, and Nov. 22, 2023, may be eligible to claim $20 from a class action settlement. There are about 1,028,000 individuals in the class.

Banner Health agreed to resolve a lawsuit alleging it improperly disclosed patient information to third parties through tracking technologies on its website and applications.

Who can file a claim?

Class members must meet the following criteria:

  • They had a Banner Health patient account (formerly known as the MyBanner patient portal).
  • They logged into their account using one of Banner Health’s web properties or applications at any time from June 1, 2020, through Nov. 22, 2023.
  • They are an individual and not a business or organization.

If an individual received a notice about this settlement, records indicate they are a class member.

How much can class members get?

Each class member who submits a valid claim can receive a $20 cash payment.

In addition, all class members will automatically receive a code to enroll in one year of CyEx Privacy Shield Pro, a privacy protection service that includes dark web monitoring, VPN In Touch, password scan, private search functionality, password defense, digital vault and data broker opt-out services.

How to claim a settlement payment

Class members can complete the online claim form or download, print and complete the PDF claim form and mail it to the settlement administrator.

The claim deadline is Sept. 5, 2026.

Settlement fund breakdown

The settlement fund will cover:

  • Settlement administration costs: To be determined
  • Attorneys’ fees and costs: Up to $3,750,000
  • Service awards to class representatives: $2,500 each to eight representatives ($20,000 total)
  • CyEx Privacy Shield Pro benefit: Cost determined by number of valid claims
  • Payments to eligible class members: $20 per valid claim

  • Final approval hearing: Sept. 10, 2026

When is the Banner Health settlement payout date?

The settlement administrator will distribute payments to eligible class members approximately 60 days after the court resolves any appeals and grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged Banner Health disclosed personally identifiable information and protected health information of patient portal users to third parties, such as Meta (Facebook) and Google through tracking technologies on its website. The plaintiffs claimed Banner Health violated privacy and other laws.

Banner Health denied all wrongdoing. Both sides agreed to settle to avoid the uncertainty and expense of litigation.
