
Individuals in the United States who sent a “stop” text to Athena Bitcoin between Aug. 20, 2020, and Aug. 20, 2024, but continued to receive at least two telemarketing text messages from it more than 30 days later may qualify to submit a claim for a cash payment from a class action settlement.
Athena Bitcoin Inc. agreed to pay $4.5 million to settle a class action lawsuit alleging it sent telemarketing text messages to individuals after they requested the messages stop in violation of federal law.
Two settlement classes, IDNC and FTSA, share the $4.5 million settlement fund. FTSA class members can file a claim here.
Who can file a claim for a TCPA payout?
IDNC class members must meet the following criteria:
- They subscribed to a residential telephone number (not a business number) in the United States at any time between Aug. 20, 2020, and Aug. 20, 2024.
- They sent a text message containing only the word “stop” to Athena Bitcoin during the qualifying period.
- They received at least two text messages from Athena Bitcoin promoting goods or services more than 30 days after sending the “stop” request.
How much are settlement payments?
Pro rata cash payment: Class members can submit a claim to receive a cash payment from the net settlement fund. The settlement administrator will determine the final payment amount by the number of text messages the class member received after sending the "stop" request and the total number of claims filed.
How to claim a class action rebate
To receive a settlement payment, IDNC class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

- Attorneys' expenses: To be presented to the court for approval at a later date
- Service award to class representative: Up to $9,000
- Payments to approved IDNC and FTSA claimants: Remaining settlement funds

When is the Athena Bitcoin TCPA settlement payout date?
The settlement administrator will issue payments to all approved FTSA and IDNC claimants after it completes claim processing and the court grants final approval of the settlement.
Why did this class action settlement happen?
The class action lawsuit alleged Athena Bitcoin Inc. sent telemarketing text messages to individuals who requested the messages end by replying “stop.” The plaintiff claimed this violated the Telephone Consumer Protection Act, which restricts unsolicited telemarketing communications.
Athena denied the allegations but agreed to settle to avoid the risk and expense of further litigation and a possible trial.
