Individuals who received notice that the August 2024 Albany College of Pharmacy and Health Sciences data breach may have affected their personal information could be eligible to claim up to $5,080 from a class action settlement.
Albany College of Pharmacy and Health Sciences agreed to settle a class action lawsuit alleging it failed to adequately protect private information during a cybersecurity incident in August 2024. The data breach may have exposed private information, including Social Security numbers, financial information, passport numbers, driver's license numbers and other sensitive information.
Who is eligible to file a claim?
Class members are individuals residing in the United States whose personally identifiable information the ACPHS data security incident that occurred between Aug. 31, 2024, and Sept. 14, 2024, potentially impacted, including those who received notice of the incident.
How much are settlement payments?
Class members have the following benefit options:
- Reimbursement for documented losses: Class members with out-of-pocket losses traceable to the data security incident may qualify to claim up to a maximum of $5,000 per person. These expenses include losses from identity theft or fraud, fees for credit reports or credit monitoring, costs to replace IDs and postage for contacting banks.
- Compensation for lost time: Eligible class members can claim up to four hours at $20 per hour (maximum $80) for time spent spent responding to the incident, such as time spent changing passwords or investigating suspicious activity.
- An alternate cash payment: Individuals who do not wish to claim for documented losses or lost time may claim a one-time cash payment of $25.
- Credit monitoring: All class members are eligible for two years of CyEx Financial Shield Total credit monitoring, which provides $1 million in financial fraud insurance and monitors for identity theft, unauthorized transactions, and high-risk activity.
How to claim a class action rebate
To receive compensation, class members can submit an online claim form or download, print and complete the PDF claim form and mail it to the settlement administrator. Class members can also request a paper claim form from the settlement administrator.

Required proof and claim information
- For reimbursement of documented losses, claimants must provide evidence, such as bank statements, receipts or other records showing the amount spent or lost as a result of the data security incident. Self-prepared notes alone are not sufficient.
- For lost time compensation, class members must attest to the number of hours spent and describe the activities performed.
- For the alternate cash payment, claimants do not need to provide no documentation or explanation but must submit a claim form.
- For online claims, class members must provide the login ID and PIN from the settlement notice they received.

When is the Albany College of Pharmacy and Health Sciences payout date?

Why did this class action settlement happen?
The class action lawsuit claimed a criminal third party gained unauthorized access to ACPHS’s network in August 2024, potentially exposing the sensitive private information of students, employees and others. The plaintiffs alleged ACPHS did not take adequate steps to protect this information.
ACPHS denied any wrongdoing but agreed to settle the lawsuit to avoid the costs and uncertainties of continued litigation.
