Individuals or businesses who received an unsolicited fax from the American College of Medical Quality between Aug. 6 and Aug. 10, 2022, may be eligible to submit a claim for up to $500 from a class action settlement. The settlement class includes an estimated 7,200 unique fax numbers.

American College of Medical Quality Inc. (ACMQ), along with Daniel J. McLaughlin and Affinity Strategies LLC, has agreed to pay to settle a class action lawsuit. The plaintiff claimed that ACMQ and its co-defendants sent unsolicited fax advertisements in violation of the Telephone Consumer Protection Act (TCPA) and related common law claims, including trespass to chattels and conversion.

Who can file a claim for a TCPA settlement payout?

Class members must meet the following criteria:

  • They had a fax number that was sent a fax in the form of Exhibit A from the settlement website.
  • The fax was sent and received at any time between Aug. 6 and Aug. 10, 2022.

How much are settlement payments?

Pro rata cash payment: Class members can submit a claim to receive a pro rata cash payment of up to $500. The total payout to all eligible claimants will not exceed $175,000. The final payment amount will be determined by the number of claims filed.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or complete the claim form they received with their notice and mail or fax it to the settlement administrator.

When is the American College of Medical Quality TCPA settlement payout date?

Why was there a class action settlement?

This class action lawsuit was filed because Loop Spine & Sports Center Ltd. alleged that ACMQ, Affinity Strategies LLC, and Daniel J. McLaughlin sent unsolicited fax advertisements in violation of the Telephone Consumer Protection Act and common law claims such as trespass to chattels and conversion.

The defendants denied the allegations, but agreed to settle the case to avoid the expense and risk of continued litigation.
