
Individuals who received two or more prerecorded voice messages from NexGen Air Conditioning and Heating LLC since Oct. 14, 2020, may be eligible to claim approximately $21 from a class action settlement.
NexGen Air Conditioning and Heating LLC agreed to pay $3,803,835 to settle a class action lawsuit claiming it sent prerecorded voice messages in violation of the Telephone Consumer Protection Act and the Florida Telephone Solicitation Act.
Who is eligible for a TCPA payout?
Class members must meet the following criteria:
- They received two or more prerecorded voice messages on their telephone from NexGen Air Conditioning and Heating.
- NexGen initiated the calls using the Drop Cowboy platform.
- They received the calls between Oct. 14, 2020, and the present.
- The prerecorded messages encouraged the purchase, rental or investment in NexGen’s property, goods or services.
- Their phone number is on the official class list.
How much will the class action settlement payment be?
Pro rata cash payment: Class members can submit a claim to receive an estimated cash payment of $21. The settlement administrator will determine the final payment amount using the number of valid claims.
How to claim a TCPA class action rebate
To receive a settlement payment, class members must submit a claim form. There are two ways to file:
- Complete the online claim form.
- Print and mail the PDF claim form to the settlement administrator.

Class members must submit the online form or postmark their form by Feb. 10, 2026.
Required claim information
- To submit a claim online or by mail, class members must provide the class member ID from their official settlement notice.
- Claimants must also provide the telephone number that received the prerecorded messages.
Payout options
Approved claimants will receive a paper check via mail to the address they provide on the claim form.
$3.8 million TCPA settlement fund
The settlement fund of $3,803,835 will include:
- Settlement administration costs: Up to $250,000
- Attorneys' fees and expenses: Up to $1,255,265.55
- Service award to class representative: Up to $7,500
- Payments to valid claimants: Remaining settlement funds

When is the NexGen Air Conditioning and Heating prerecorded call settlement payout date?
The settlement administrator will issue payments to approved claimants approximately 90 days after the court grants final approval of the settlement.
Why is there a class action settlement?
This class action lawsuit alleged NexGen Air Conditioning and Heating LLC sent prerecorded voice messages to individuals without proper consent, violating the Telephone Consumer Protection Act and the Florida Telephone Solicitation Act.
NexGen denies any wrongdoing. The parties agreed to settle to avoid the expense and risk of a trial and continued litigation.
