Nonexempt hourly employees who worked at a corporate-owned WellNow Urgent Care location in Illinois, New York or Pennsylvania during specific periods may be eligible to claim a cash payment from a class action settlement.
WellNow Urgent Care PC agreed to pay $1.64 million to settle a class action lawsuit alleged it violated the Fair Labor Standards Act and state wage-and-hour laws by not paying correct wages and overtime to its workers.
Who can file a claim?
The settlement considers individuals class members if WellNow’s records show they worked as a nonexempt hourly employee (with direct patient care duties) at a corporate-owned WellNow Urgent Care location during one or more of the following periods:
- In New York: From June 6, 2017, through the date the court granted preliminary approval of the settlement
- In Illinois (Illinois minimum wage law claims): From June 8, 2023, through the preliminary approval date
- In Illinois (Illinois Wage Payment and Collection Act claims): From June 8, 2016, through the preliminary approval date (if the class member clocked out for a meal break and/or they were subject to time rounding)
- In Pennsylvania: From June 8, 2023, through the preliminary approval date
The settlement also categorizes class members based on their participation in the lawsuit. The settlement uses a points system to determine each member's share of the settlement fund:
- Opt-in plaintiffs: Individuals who previously joined the lawsuit under the FLSA collective action receive two points for each pay period worked between June 6, 2020, and the preliminary approval date
- Non-opt-in plaintiffs: Receive one point for each pay period worked in the applicable state during the class period
It is possible for class members to be eligible under more than one category, depending on their work history and the state(s) in which WellNow employed them.
How much can class members receive?
The total settlement fund is $1,640,000. After deductions for service awards to the named plaintiffs, administration costs, attorneys’ fees and expenses, and taxes, the settlement administrator will distribute the remaining amount to class members and opt-in plaintiffs based on the points system.
The administrator will divide the net settlement fund by the total number of class member points to determine the value per point. It will then calculate each class member’s payment as follows:
- (Number of points assigned) x (value per point) = individual payment
The settlement administrator will consider half of each payment back wages (subject to tax and W-2 reporting and the other half liquidated damages and interest (subject to 1099 reporting).
Each class member’s settlement notice provides their estimated payment. The actual amount may be higher or lower depending on the total number of valid claims and final deductions.
How to claim a WellNow class action payment
To receive a payment, class members must complete and sign the claim form included with their notice or the PDF claim form from the settlement website. They can return the claim form by mail using the postage-paid envelope from their notice, their own envelope or by scanning and emailing the form to the claims administrator. There is no online claim form link provided on the official settlement website.

What proof or documentation is required to submit a claim?
The settlement administrator already has class members’ information based on WellNow’s records. However, if an individual wishes to dispute the number of pay periods credited to them, they may submit documentation supporting their claim to the administrator by the claim deadline.
Payout options
The settlement administrator will mail checks to the address provided on the claim form. Class members must cash their checks within 150 days of mailing.
$1.64 million settlement fund breakdown
The $1,640,000 settlement fund will cover:
- Settlement administration costs: To be determined
- Attorneys’ fees: Up to $574,000
- Attorneys’ expenses: To be determined
- Service awards to named plaintiffs: $5,000 each to three plaintiffs ($15,000 total)
- Payments to eligible class members: Remaining net settlement fund after above deductions

When is the WellNow Urgent Care settlement payout date?
The settlement administrator will issue payments after the court resolves any appeals and grants final approval of the settlement.
Why is there a class action settlement?
The class action lawsuit alleged WellNow violated federal and state wage-and-hour laws. The claims included failure to pay minimum wage, unpaid overtime, improper wage deductions and other related violations.
WellNow denies any wrongdoing or liability but agreed to settle to avoid the uncertainty and expense of continued litigation.
