Consumers who received a mailed notice from the San Francisco 49ers stating their personal or financial information was affected by a February 2022 data incident may qualify to claim an estimated $10 to $30 from a class action settlement.

The San Francisco 49ers agreed to pay $610,000 to resolve a class action lawsuit alleging a ransomware attack allegedly compromised the personal data of certain individuals.

Who are the class members?

Class members must have received a notice from the San Francisco 49ers stating their personal and/or financial information was impacted in a data breach that occurred Feb. 6-11, 2022.

The potentially exposed information may include names, dates of birth, Social Security numbers and/or other personal identifiers.

There are two groups within the class:

  • California settlement subclass members: California residents at the time of the breach
  • Other settlement class members: Individuals who were not California residents at the time of the breach

How much is the San Francisco 49ers payout?

Pro rata payment: The settlement provides a cash payment to all class members with the amount depending on residency and the final number of participants. California settlement subclass members receive three shares of the settlement after deductions, such as attorneys' fees and settlement administration costs. Other settlement class members receive one share each.

Estimated payouts:

  • California settlement subclass members: Approximately $30 each
  • Other settlement class members: Approximately $10 each

These amounts are estimates and may change depending on the actual number of claimants, the court’s final approval of fees and costs and any redistribution of funds from uncashed checks.

No action needed to receive compensation

Class members do not need to file a claim to receive their payment. The settlement administrator already has the information needed to identify class members. They will receive a paper check mailed to the address the 49ers have on file.

Class members can update their address or request an electronic payment online or by writing to the settlement administrator.

Why did this class action settlement happen?

The class action lawsuit alleged cybercriminals bypassed the San Francisco 49ers’ security systems in February 2022 and accessed sensitive personal information as part of a ransomware attack. The plaintiffs claimed the 49ers failed to adequately protect personal data, leading to the exposure of names, dates of birth, Social Security numbers and other information.

The 49ers deny any wrongdoing but agreed to settle to avoid the cost and uncertainty of further litigation. As part of the settlement, the team also agreed to implement enhanced security measures to better protect personal information in the future.
