Individuals who lived at Pathfinder Village Apartments in Fremont, Calif., and paid an alleged unlawful rent increase or late fee between Aug. 27, 2017, and May 3, 2022, may qualify to receive a cash payment from a class action settlement.

Aimco Pathfinder Village Apartments LP and related defendants agreed to pay $275,000 to settle a class action lawsuit alleging it charged charged tenants via rent increases and late fees in violation of the City of Fremont’s Rent Review Ordinance and California law.

Who is eligible for an Aimco payout?

The class includes all current or former tenants who meet the following criteria:

  • They lived at Pathfinder Village Apartments, 39800 Fremont Blvd., Fremont, CA 94538, at any time between Aug. 27, 2017, and May 3, 2022.
  • They paid an alleged unlawful rent increase and/or a late fee during that period.

The settlement applies to both single-tenant and multi-tenant households:

  • If multiple tenants were listed on a lease, all tenants are considered class members for that household.
  • Households may have claims for rent increases, late fees or both.

How much can class members receive?

The total settlement fund is $275,000, which the settlement administrator will distribute to eligible class members after deducting attorneys’ fees, litigation costs, a service award to the lead plaintiff and administration costs.

The settlement allocates:

  • 88.37% of the net fund to claims for unlawful rent increases
  • 11.63% of the net fund to claims for unlawful late fees

Each class member’s payment is calculated on a pro rata basis. This means the amount each household receives depends on how much they paid in unlawful rent increases and/or late fees compared to the total amount paid by all class members.

If the total settlement fund is less than the total claims, each class member’s share will be reduced proportionally. If there are unclaimed funds (for example, if a check is not cashed within 90 days), those funds will be donated to nonprofit organizations approved by the court and will not revert to the defendants.

No action needed to receive payment

Eligible class members do not need to file a claim to receive their payment. The settlement administrator will automatically calculate each household’s share and mail a check to the address on file. There is no online or PDF claim form to complete.

Class members whose address has changed since they lived at Pathfinder Village Apartments should contact the settlement administrator to update their information and ensure they receive payment.

Payments will be made by check mailed to the address on file for each eligible class member.

$275,000 settlement fund breakdown

The $275,000 settlement fund covers:

  • Settlement administration costs: $10,888
  • Attorneys’ fees: Up to $90,750
  • Service award to class representative: Up to $20,000
  • Payments to eligible class members: The remainder of the fund.

Why is there a class action settlement?
